Smt Meghana Singh, daughter-in-law of opposite party no. 2 Smt Sushma Khokhar, had prayed for transfer of Criminal Misc. Application u/s 12 Domestic Violence Act bearing No. 438 of 2024, pending before the Civil Judge (Junior Division), FTC-1, Ghaziabad, to a court of competent jurisdiction at District Lucknow. At the hearing she did not press the transfer, offering instead to appear through video conferencing; Sri Imran Khan, learned AGA for the State-respondent, raised no objection. Sri Romeshwari Prasad, learned counsel for the applicant and Sri Imran Khan, learned AGA for the State-respondent are present.

The instant transfer application has been filed by the applicant with a prayer to transfer the criminal Misc. Application u/s 12 Domestic Violence Act, bearing No. 438 of 2024, pending in the Court of Civil Judge (Junior Division), FTC-1, Ghaziabad to the court of competent jurisdiction at District Lucknow.

At the very outset, learned counsel for the applicant submitted that applicant is daughter in law of the opposite party no. 2 and she filed instant transfer application with a prayer to transfer the trial of the case relates to section 12 of Domestic Violence Act from District Gaziabad to Lucknow but applicant is ready to appear through video conferencing and therefore, the instant application may be disposed off with the direction that if applicant filed an application before appropriate forum to appear through video conferencing then her application shall be entertained and she will be permitted to appear through video conferencing.

Learned AGA is having no objection.

The instant transfer application has been filed by the applicant who is daughter in law of the opposite party no. 2 with a prayer to transfer the case from District Gaziabad to Lucknow but now she is ready to pursue the matter through video conferencing, therefore, instant transfer application is disposed off with a direction that if applicant filed an application to pursue through video conferencing then her application shall be considered and she will be permitted to pursue the matter through video conferencing.
