Allahabad High Court (Hon'ble Sameer Jain, J.), Transfer Application (Criminal) No. 409 of 2024, decided October 27, 2025: The applicant, Manish Kumar Verma @ Uday (husband), sought transfer of Case No. 9756 of 2024 (Aradhana Srivastava Vs Manish Kumar Verma @ Uday), under Sections 498A, 323, 504 & 506 IPC and Section 3/4 D.P. Act, pending before the Special Women Court, Etawah, from District Etawah to District Agra. At hearing, counsel for the applicant submitted that the applicant was ready to appear through video conferencing and prayed for disposal with a protective direction; learned AGA-I (Dr. S.B. Maurya) and counsel for opposite party no.2 (Lavkush Dixit) had no objection. Heard Sri Lavkush Kumar Shukla, learned counsel for applicant, Shri Lavkush Dixit, learned counsel for the opposite party no.2 and Dr. S.B. Maurya, learned AGA-I for the State.

The instant transfer application has been filed by the applicant with a prayer to transfer the Case No. 9756 of 2024, Aradhana Srivastava Vs Manish Kumar Verma @ Uday, under Sections 498A, 323, 504 & 506 IPC and Section 3/4 D.P. Act pending in the Court of Learned Special Women Court, Etawah having competent jurisdiction.

At the very outset, learned counsel for applicant submits, however, applicant is the husband of the opposite party no.2 and he filed the instant transfer application with the prayer to transfer the trial of the case from District Etawah to District Agra but now applicant is ready to appear through video conferencing and, therefore, instant transfer application may be disposed of with the direction that if applicant filed an application before appropriate forum to appear through Video Conferencing then his application shall be entertained and he will be permitted to appear through Video Conferencing.

Learned AGA as well as learned counsel for the opposite party no.2 is having no objection.

In view of the contention raised by learned counsel for the applicant, instant transfer application stands disposed of with the direction that that
