Heard Sri Siddharth Srivastava, learned counsel for applicant and Shri Manoj Kumar, learned brief holder of the State.

The instant transfer application has been filed by the applicant with a prayer to transfer the proceeding of Case Crime No.202 of 2023, State vs. Shiv Govind and Others, under Sections 498A, 323,504 & 506 IPC and Section 3/4 DP Act, Police Station-Phaphund, District-Auraiya pending in the court of Chief Judicial Magistrate, Auraiya to other competent court in District Raibarelly having competent jurisdiction.

At the very outset, learned counsel for applicant submits, however, applicant is the wife of the opposite party no.2 and she filed the instant transfer application with the prayer to transfer the trial of the case from District Auraiya to District Raibarelly but now applicant is ready to appear through video conferencing and, therefore, instant transfer application may be disposed of with the direction that if applicant filed an application before appropriate forum to appear through Video Conferencing then his application shall be entertained and he will be permitted to appear through Video Conferencing.

Learned AGA is having no objection.

In view of the contention raised by learned counsel for the applicant, instant transfer application stands disposed of with the direction that that
