The present application under Section 24 of the Code of Civil Procedure has been preferred by the applicant seeking transfer of proceedings of Case No. 3467 of 2024 (Gaurav Rastogi Versus Priyanka Rastogi alias Paridhi Rastogi and another) under Section 13 of the Hindu Marriage Act, from the Court of Additional Principal Judge-5th, Family Court, Lucknow to the Court of equivalent jurisdiction at District Gonda.

The submission of the learned counsel appearing on behalf of the applicant is that the applicant herein is permanently residing at Gonda and the opposite party resides at Bahraich but just to harass the applicant, the divorce petition under Section 13 of the Hindu Marriage Act has been filed at Lucknow. It is contended on behalf of the applicant that the cases under the Domestic Violence Act as well as for the maintenance and also a criminal case filed by the applicant are pending at Gonda. It is also submitted on behalf of the applicant that the applicant being a lady is facing hardship in pursuing the case at Lucknow, as such, she wants the transfer of the case from Lucknow to Gonda.
