Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Learned counsel for the applicant has submitted that the applicant is a complainant in Complaint Case No.5394/2014 (Mrityunjay Datta Tiwari Vs. Kailash Bihari Lal Srivastava and others) under section 406, 420, 506 IPC, Police Station Dhoomanganj, District Prayagraj, which is pending in the Court of Additional Chief Judicial Magistrate, Court No.5, Allahabad. It is stated that the case is pending for disposal because opposite parties/accused are absconding and are evading from the proceedings. He, however, has informed that the processes under Section 82 and 83 Cr.P.C. have been issued against the accused persons for securing their presence. Learned counsel, therefore, prays that a direction be issued to the learned trial court to decide the said case as expeditiously as possible.

Considering the submissions made by the learned counsel for the applicant, the concerned trial court will make endeavour to decide the case as expeditiously as possible by seeking the compliance report from the concerned authorities regarding the
