Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

This application under Section 529 BNSS has been filed seeking direction to the court below for expeditious disposal of Case No.822 of 2023, arising out of Case No.349 of 2020 (Amrish Singh vs. Saroj Kumari and another), under Section 126 (2) Cr.P.C. pending before court of Principal Judge Family Court, Auraiya within a stipulated period of time as fixed by this Court.

Upon query made by this Court as to what is the urgency, learned counsel for the applicant could not show any ground for a direction to the court below.

I do not find any ground to pass such order looking to the fact that number of cases are pending before the trial court waiting for its logical conclusion and in the circumstances, no such direction can be issued to decide a particular case within a stipulated time. However, it is expected that the court below shall consider and decide of the matter pending before it in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible.

Accordingly, the instant application is dismissed .
