Sri Sudhir Kumar, learned counsel for the accused-applicant appears and submits that the present application under Section 528 of BNSS has been moved to quash the impugned order dated 06.06.2023 passed by the Sessions Judge, Meerut in Bail Application No. 3623 of 2023 (Umesh Siddharth Vs. State of U.P.) to the extent the applicant has been directed to give maintenance to opposite party no. 2 and her child to the tune of Rs. 15,000/- and other direction regarding expenses of education and medical aid to the child.

Learned AGA for the State-opposite party no. 1 is present.

There is no need to issue notice to the opposite party no. 2.

While deciding the bail application of the accused-applicant, the Sessions Judge, Meerut has merely entered the arguments of the parties raised before the court, which is in paragraph no. 5 of the bail order. The same is reiterated underneath :-

"5- जमानत प्राथर्ना पत्र की सुनवाई के दौरान पक्षों के मध्य सहमित बनी है है िक आवेदक वािदया और उसके बच्चे सारांश के मकान का िकराया व खचार् आिद के िलये रूपया पन्द्रह हजार प्रितमाह अदा करेगा और वािदया को पली का दजार् भी देगा। इसके अितिरक्त अपने पुत्र सारांश को अपनी समस्त चल व अचल सम्पित्त में पूणर् हक देगा और उसका समस्त खचर् िजसमें िशक्षा तथा बीमारी आिद

सिम्मिलत रहेगी। इन पिरिस्थितयों में यह उिचत होगा िक मामले के गुण दोष पर कोई मत व्यक्त िकये िबना, आवेदक को सशतर् जमानत पर िरहा कर िदया जावे। तदनुसार जमानत प्राथर्ना पत्र स्वीकार िकये जाने योग्य है।"

But the operative portion of the order does not contain the aforesaid agreement. The operative portion of the order is reiterated underneath:-

"आवेदक उमेश िसद्धाथर् द्वारा मु०अ०सं०-097/2023, अन्तगर्त धारा-376, 506 भा०दं०सं०, थाना टी० पी० नगर, िजला मेरठ के प्रकरण में प्रस्तुत जमानत प्राथर्ना पत्र संख्या-3623/2023 स्वीकार िकया जाता है।

आवेदक द्वारा रूपया पचास हजार का व्यिक्तगत बंध पत्र व इतनी ही धनरािश के दो प्रितभू पत्र सम्बिन्धत न्यायालय की सन्तुिष्ट में दािखल करने पर आवेदक को िनम्निलिखत शतोर्ं के अधीन जमानत पर िरहा िकया जावे।

1- आवेदक बंध पत्र की शतोर्ं के अनुसार उपिस्थत होगा।

2- आवेदक िवचारण के प्रारम्भ की अवस्था, आरोप िवरिचत होने की िदनांक एवं धारा 313 दं०प्र०सं० के अन्तगर्त परीक्षण की िदनांक को व्यिक्तगत रूप से न्यायालय में उपिस्थत होगा।

3- आवेदक वतर्मान मामले के तथ्यों से अवगत िकसी व्यिक्त को प्रत्यक्षतः या अप्रत्यक्षतः कोई उत्प् र ेणा, धमकी या वचन इस प्रकार का नहीं देगा िक अवगत होने वाला व्यिक्त न्यायालय या पुिलस अिधकारी के समक्ष ऐसे तथ्यों को प्रकट न कर सकेगा।

4- आवेदक साक्ष्य को नष्ट नहीं करेगा।

5- जो अिभयोग आवेदक पर लगाया गया है, वैसा ही अन्य कोई अपराध आवेदक नहीं करेगा।

6- यिद आवेदक द्वारा दी गयी अण्डरटेिकग का पालन नहीं िकया जाता है तो उसकी जमानत िनरस्त की जा सकती है।

This Court is of the view that there is no condition imposed by the Session Judge while disposing of the bail. Hence, the application is accordingly, disposed of .
