The present bail application has been moved by the applicantaccused Shabab Akhtar Alias Rahul for the offence punishable under Sections 178, 179, 180, 181 BNS in Case Crime No.1115 of 2024, Police Station - Majhola, District – Moradabad.

Sri Santosh Kumar Gupta, learned counsel for the applicant submits that the accused-applicant has been falsely implicated in the case, wherein, the counterfeit currency notes have been recovered from the possession of the three accused persons from the house of one of the accused. Accused is in jail since December, 2024. Accused-applicant does not have any criminal history. Charge sheet has been submitted. As such, the accused applicant is liable to be released on bail.

Per contra, learned A.G.A. for the State has opposed the bail application and submits that counterfeit currency notes and the machines of printing of such note have been confiscated by the police. The currency notes on the various denomination amounting to Rs.2,74,540/- has been recovered. Charge sheet has been submitted.

This Court has taken into consideration the rival submissions made by the parties and perused the record.

The perusal of the record prima facie reveals that the accused applicant is in jail since December, 2024. The charge sheet has been submitted. The recovery has been made in absence of independent witness. There is no criminal history against the accused-applicant.

Without touching the merit of the case, this bail application is allowed.

Let the accused-applicant Shabab Akhtar Alias Rahul be enlarged on bail subject to furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
