Allahabad High Court (Avnish Saxena, J.), interim order dated December 9, 2025, in Application u/s 528 BNSS No. 48986 of 2025 (Arjun Rajbhar v. State of U.P. and 3 others): Applicant, arraigned in S.T. No. 155 of 2025 (State Vs. Arjun Rajbhar) arising out of Case Crime No. 115 of 2024, P.S. Rasra, District Ballia, under Sections 363, 366, 376(3) IPC and Section 5L/6 POCSO Act (FIR of enticement lodged by the victim's mother), sought quashing of the charge sheet and proceedings on the ground that he and the victim, both adults, had married per Hindu Rites and Ceremonies and a compromise existed between the applicant-accused, victim and informant (at page no. 66). Counsel for the informant (opposite party no.2) admitted the compromise and the marriage. Sri Buddha Prakash, learned counsel for the applicant appears and submits that the FIR of enticement has been lodged by mother of victim. The victim and applicant are adult and entered into marriage as per Hindu Rites and Ceremonies. He submits that the victim is pregnant. He submits that there is compromise between the applicant-accused, victim and informant, which is at page no. 66. He seeks interference of this Court to quash the charge sheet and the proceedings, as the parties have entered into marriage ties.

Learned AGA is present for the State-opposite party no.1.

Sri Pramod Kumar Gupta, learned counsel for the opposite party no.2/informant appears and hands up Vakalatnama, the same is taken on record. The name of learned counsel be shown in the cause list. He has admitted the factum of compromise and marriage between the applicant and victim. He also hands up the short counter affidavit disclosing the facts as mentioned above, the same is taken on record.

None appeared on behalf of opposite party nos. 3 and 4.

List on 16.02.2026 amongst top ten cases.

In the meantime, the parties may exchange affidavits.

The parties may appear before the trial court and file the compromise entered into between the parties, which shall be verified by the trial court.
