This application under Section 528 B.N.S.S. has been filed by the applicant to quash the charge-sheet No.39/24 dated 22.03.2024, cognizance/summoning order dated 26.11.2024 passed by the Additional Sessions Judge/Special Judge (POCSO Act), Etawah in Special Case No.1186 of 2024 (State vs. Ravi @ Shivkumar and others) arising out of Case Crime No.0011 of 2024, under Sections 323, 427, 452, 504, 506, 354B I.P.C. & 3(1)Da, 3(1)Dha, 3(1)W, 3(2)va SC/ST Act & 7/8 POCSO Act, P.S. Chaubiya, District Etawah, pending before Additional Sessions Judge/Special Judge (POCSO Act), Etawah.

On the matter being taken up, learned counsel for the applicant has not pressed the relief as sought by means of this application on merit and prayed for issuance of appropriate direction to the concerned Courts below to decide the bail application of the applicant expeditiously.

Learned A.G.A. has no objection in allowing the aforesaid prayer of the applicant.

Accordingly the relief as sought by the applicant through this application is refused.

Considering the aforesaid alternative prayer of the applicant, it is directed that applicant shall surrender before the concerned Court below within three weeks from today and in case applies for bail, the bail
