Sri Shri Kant Kesarwani, learned counsel for the applicants and Sri Manish Goyal, learned Additional Advocate General assisted by Sri Pankaj Saxena, learned AGA, for the State, are present.

The instant application has been filed by the applicants with a prayer to quash the entire Criminal Case No.1950 of 2007(State of U.P. Vs. Prabha Shankar Pandey and others) pending in the court of Additional Chief Judicial Magistrate-10th (MP/MLA), Allahabad whereby applicants have been charge sheeted vide Charge Sheet No. 711 of 1988 dated 23.4.1988 and cognizance order dated 15.9.1988 and summoning order dated 5.4.1991 as well as quashing the NBW dated 5.9.2011 and Section 82 Cr.P.C. proceeding dated 16.9.2016 which is still continuing against the applicants till 9.11.2025 in Case Crime No.53 of 1988, under Sections 147, 452, 332, 353, 504, 506 and 427 IPC, Police Station Nawabganj, District Prayagraj.

At the very outset learned counsel for the applicants submits that however, applicant no.1 is Ex-MLA and applicant no.2 is his cousin brother and they filed the instant application to quash the entire criminal proceedings pending against them but now applicants do not want to press the instant application and, therefore, the same may be dismissed as withdrawn.
