Short counter affidavit filed by learned counsel for the opposite party no.2 is taken on record.

Sri Ram Prakash Dwivedi, learned counsel for the applicant, Sri R.K. Tiwari, learned counsel for the opposite party no.2 and learned A.G.A. for the State are present.

Learned counsel for the applicant submits that the applicant and opposite party no.2 were in a live-in relationship. The F.I.R. has been lodged merely due to a dispute between the two, wherein the false allegation of rape has been levelled against the applicant on the promise of marriage. Both were already married. Learned counsel has relied on the case of Madhukar and others Vs. State of Maharashtra and another [2025 SCC OnLine SC 1415] . He further submits that there is compromise between the two. The application is at page no.156, which has been signed by the opposite party no.2 that she does not want to continue with the case. Hence, he seeks intervention of this Court.

Learned counsel for the opposite party no.2 files short counter affidavit along with the vakalatnama. He admits that the compromise entered into between the parties and also filed the same along with the short counter affidavit.

Learned A.G.A. accepts notice for the State.
