Heard Sri Hans Raj Singh, learned counsel for the applicant and Sri J. P. Singh, learned A.G.A. for the State-opposite party no.1.

The present application u/s 528 of B.N.S.S. has been filed with prayer to allow this application and direct learned Additional Sessions Judge/F.T.C., Court No.2, Rampur, to decide the Session Trial No.416 of 2013, arising out of Case Crime No.484 of 2010, under sections 147, 148, 149, 307, 427, IPC, Police Station Milak, District Rampur.

It is contended by the learned counsel for the applicant that the applicant is facing trial in Session Trial No.416 of 2013, arising out of Case Crime No.484 of 2010, under sections 147, 148, 149, 307, 427, IPC, Police Station Milak, District Rampur, before the court of learned Additional Sessions Judge/F.T.C., Court No.2, Rampur. It is further contended by the learned counsel for the applicant that the trial is moving at snail's pace and till date no prosecution witness hes been examined in the matter, even after a lapse of 12 years of the committal of the case to the court of session by the learned Magistrate. It is further argued and prayed by the learned counsel for the applicant that a directed be given to learned trial court i.e. learned Additional Sessions Judge/F.T.C., Court No.2, Rampur, to decide the above sessions trial, expeditiously.

On the other hand, learned A.G.A. for the State has not opposed the prayer so made by learned counsel for the applicants.

In view of the above, this application is disposed of with the direction to learned trial court i.e. learned Additional Sessions Judge/F.T.C., Court No.2, Rampur, to decide the Session Trial No.416 of 2013, arising out of Case Crime No.484 of 2010, under sections 147, 148, 149, 307, 427, IPC, Police Station Milak, District Rampur, expeditiously, preferably within a period of one year, by taking all necessary steps for securing the presence of the witnesses by giving short dates.

With the aforesaid direction, the present application is hereby disposed of.
