Case is called out in the revised list, no one appears for opposite party nos.2 to 5. Office report dated 11th November, 2025 records that notice has been served upon opposite party nos. 4 and 5, whereas, notice upon opposite party nos. 2 and 3 could not be served as opposite party no.2 has denied to accept the same.

Heard Mr. Jagdev Singh, learned counsel for the revisionist and the learned Additional Government Advocate for the State.

This criminal revision under Section 397/401 Cr.P.C. has been filed by the revisionist to set aside/quash the interim order dated 22nd March, 2024 passed by the Principal Judge, Family Court, Bijnor in Criminal Misc. Case No. 326 of 2022 (Smt. Priyanshi & 3 Others Vs. Yogesh Kumar) under Section 125 Cr.P.C., whereby the trial court while partly allowing the interim application no. Kha-19 filed in the instant application under Section 125 Cr.P.C. has directed the revisionist to pay Rs. 5,000/- per month to opposite party no.2 (wife) and Rs. 2,000/- per month each to opposite party nos. 4 and 5 (minor daughters) towards monthly interim maintenance allowance from the date of filing of application no. Kha-19.

From the perusal of the record, it appears that the revisionist is the husband of opposite party No. 2.

Learned counsel for the revisionist submits that the dispute between the parties is a matrimonial dispute and in case the matter is referred for mediation, the parties may get an opportunity to amicably settle their dispute. He, therefore, submits that in view of the peculiar facts and circumstances of the present case, it will be in the interest of both the parties that the parties may be referred for mediation to the Mediation Centre, High Court, Allahabad.

For showing the bona fide of the revisionist, learned counsel for the revisionist submits that the revisionist is also ready to pay Rs. 25,000/- to opposite party no.2 before the High Court Mediation and Conciliation Centre, Allahabad. The revisionist shall also pay Rs. Rs. 5,000/- per month to opposite party no.2 (wife) and Rs. 2,000/- per month each to opposite party nos. 4 and 5 (minor daughters) towards monthly interim maintenance allowance regularly as awarded by the trial court under the impugned interim order.

Accordingly, the matter is referred to Mediation & Conciliation Centre of this Court. The revisionist is directed to deposit a sum of Rs.25,000/- by way of demand draft / pay order in the name of Registrar General A/c, Allahabad High Court Mediation & Conciliation Centre within a period of two weeks from today. After deposit of the aforesaid money, office shall send a notice to the opposite party no.2 calling upon her to file counter affidavit. Out of Rs. 25,000/-, Rs. 20,000/- shall be payable to the opposite party no.2 on her appearance before the Mediation and Conciliation Centre and remaining Rs. 5,000/- shall be payable to the Mediation and Conciliation Centre. The Mediation Centre will submit its report in the matter within three months.

List this case after four months alongwith the report of Mediation Centre.

Till the next date of listing, the recovery proceedings, if any initiated against the revisionist pursuant to the 22nd March, 2024 passed by the Principal Judge, Family Court, Bijnor in Criminal Misc. Case No. 326 of 2022 (Smt. Priyanshi & 3 Others Vs. Yogesh Kumar) under Section 125 Cr.P.C. shall remain stayed provided the revisionist shall also pay Rs. Rs. 5,000/- per month to opposite party no.2 (wife) and Rs. 2,000/- per month each to opposite party nos. 4 and 5 (minor daughters) towards monthly interim maintenance allowance regularly as awarded by the trial court under the impugned interim order.

If the amount as directed above, is not deposited by the revisionist within the aforesaid period and also the monthly maintenance allowance as directed above is not paid, the stay order shall automatically come to an end and the office shall immediately list this case for further orders before the Court.
