By means of the present revision, the revisionist has assailed the order dated 23.08.2024 passed by Principal Judge, Family Court, Gonda (in short "Family Court') in Criminal Misc. Case no. 817 of 2022 (Smt. Komal Gupta Vs. Krishna Kumar Gupta).

Vide order under challenge, the Family Court, upon considering the facts of the case, directed the revisionist to pay Rs. 3,500/- per month from the date of filing of the application, under consideration, i.e. 18.07.2022. Relevant portion of the impugned order is extracted herein-under :

" जहां तक आवेिदका को िवपक्षी से अलग रहते हुए भरण-पोषण भत्ता िदलाये जाने का प्रश्न है?

आवेिदका का कथन है िक उसके िववाह में िदये गये दान दहेज से िवपक्षी व उसके घरवाले सन्तुष्ट नहीं थे और िववाह के दूसरे िदन से ही उसे कम दहेज िमलने का ताना देते थे तथा उसे व उसके घरवालों को भद्दी भद्दी बातें कहकर प्रतािड़त व अपमािनत करते थे। िवपक्षी तथा उसके घरवालों ने कहा वह अपने िपता से पल्सर मोटरसाइिकल तथा िवपक्षी का व्यवसाय बढ़ाने के िलए दो लाख रूपये लाकर दे, तब उसके मायकेवालों ने िवपक्षी को मु०-1,35,000/- रूपया मोटरसाइिकल खरीदने के िलए िदया, िजससे िवपक्षी ने मोटरसाइिकल नहीं खरीदी और उक्त रूपया अपने व्यवसाय में लगा िदया। िवपक्षी पुनः मोटरसाइिकल की मांग को लेकर उसे प्रतािड़त करने लगा। िवपक्षी ने उसके भाई गौतम से पैसों की मांग की और पैसा न िमलने पर उसके साथ मार-पीट की। उसके बीमार होने पर िवपक्षी ने उसका दवा इलाज भी नहीं कराया। अितिरक्त दहेज की मांग पूरी न होने पर िवपक्षी ने िदनांक 10.06.2020 को उसे मार-पीट कर घर से िनकाल िदया, तब से वह अपने मायके में रह रही है।

आवेिदका के कथन के िवपरीत िवपक्षी का कथन है िक आवेिदका तथा िवपक्षी का िववाह िबना दान दहेज के सम्पन्न हुआ था। िववाह के बाद िवदा होकर ससुराल आने पर आवेिदका बुझे मन

से रहती थी। िवपक्षी व उसके घरवालों ने कभी भी आवेिदका से दहेज की मांग नहीं की। आवेिदका स्वयं िववाह के बाद से ही िवपक्षी व उसके घरवालों के प्रित कटुता व क् र ूता का भाव रखती थी। आवेिदका की क् र ूता व कलह के कारण िवपक्षी की मां बीमार रहने लगी। िवपक्षी मेहनत मजदूरी करके अपनी मां का इलाज कराता था, लेिकन यह भी आवेिदका को नागवार गुजरता था। माह जून 2019 में आवेिदका पिरवार से अलग रहने की िजद करने लगी। घर में शािन्त बनाने के िलए िवपक्षी आवेिदका के दबाव में अपने माता-िपता से बंटवारा करके अलग रहने लगा। उसने आवेिदका से अपने माता-िपता की सेवा करने के िलए कहा, तब आवेिदका िदनांक 10.06.2020 को अपनी मां को बुलाकर समस्त कीमती कपड़े व जेवरात लेकर मायके चली गई। आवेिदका ने अपने मायके में रहने के दौरान पुिलस से फजीर् िशकायत की। िदनांक 14.06.2020 को सुलह समझौता केन्द्र में समझौता का प्रयास िकया गया, लेिकन समझौता नहीं हो सका। आवेिदका के दुव्यर्वहार व क् र ूता के कारण िवपक्षी की मां बीमार हो गई और दौरान इलाज िदनांक 09.07.2020 को उनकी मृत्यु हो गई। आवेिदका उसकी मां के अिन्तम संस्कार में भी शािमल नहीं हुई। आवेिदका के व्यवहार के कारण वह मानिसक अवसाद में रह रहा है। आवेिदका िबना िकसी उिचत कारण के िवपक्षी को छोड़कर िदनांक 10.06.2020 से मायके में रह रही है, इसिलए वह भरण-पोषण भत्ता प्राप्त करने की अिधकािरणी नहीं है।

पी०डब्लू०-01 श्रीमती कोमल गुप्ता ने सशपथ साक्ष्य में कहा है िक शादी में िवदा होकर िवपक्षी के घर जाने के बाद से ही िवपक्षी व उसके माता-िपता उसे दहेज के िलए प्रतािड़त करते थे। वह िवपक्षी के घर लगभग एक साल रही। इस दौरान िवपक्षी ने उसका भरण-पोषण नहीं िकया। िवपक्षी के घर रहते हुए उसका िवपक्षी से शारीिरक सम्बन्ध नहीं हुआ। सम्बन्ध न बनाने की वजह दहेज की मांग को लेकर िवपक्षी ने बराबर प्रतािडत िकया। िवपक्षी ने दहेज में दो लाख रूपये तथा पल्सर मोटरसाइिकल की मांग की, िजसमें से 1,35,000/- रूपये पल्सर गाड़ी खरीदने के िलए िदया गया। िवपक्षी के घर में रहते हुए बीमार होने पर िवपक्षी ने उसका दवा इलाज नहीं कराया। िदनांक 10.06.2020 को िदन में 11.00 बजे िवपक्षी ने उसके जेवर वगैरह छीनकर अपने घर से भगा िदया, तब से वह मायके में रह रही है। प्रितपरीक्षा में साक्षी ने कहा है िक जब वह िवदा होकर ससुराल गई थी, तब दूसरे िदन से ही दहेज की मांग करने लगे थे। दहेज मांगने की तुरन्त िशकायत कहीं नहीं िकया था। अब वह अपने पित के साथ नहीं जाना चाहती है। यह कहना गलत है िक वह कृष्ण कुमार गुप्ता से कहती थी िक वह अपने माता-िपता को छोड़कर उसके साथ रहे। जब उसकी सास की मृत्यु हुई, तब सूचना िमलने पर वह अपनी ससुराल गई थी, परन्तु िवपक्षी ने उसको घर में घुसने नहीं िदया। पी०डब्लू०-02 गौतम गुप्ता ने सशपथ साक्ष्य में कहा है िक शादी के पन्द्रह-बीस िदन बाद से दहेज को लेकर प्रतािड़त करना शुरू कर िदया। उसकी बहन कोमल को कम दहेज के िलए प्रतािड़त करते थे। दहेज में दो लाख रूपया व पल्सर गाड़ी िवपक्षी कृष्ण कुमार तथा उसके िपता ने मांगा था। उसने पल्सर गाड़ी खरीदने के िलए मु०-1,35,000/- रूपया िदया था। कृष्ण कुमार ने पल्सर गाड़ी न खरीदकर अपने मूंगफली के व्यवसाय में पैसा लगा िदया। प्रितपरीक्षा में साक्षी ने कहा है िक उसे दहेज प्रताड़ना की जानकारी शादी के पन्द्रह िदन बाद उसकी बहन ने बताई थी। उसने तुरन्त कोई िशकायत नहीं िकया था। िदनांक 11.06.2020 के बाद जब सुलह फेल हो गई, तब उसने िशकायत िकया था। पी०डब्लू०-03 तारकेश्वर गुप्ता ने सशपथ साक्ष्य में कहा है िक िवपक्षी दान दहेज में पल्सर मोटरसाइिकल व कुछ रूपयों की मांग िकये थे। जब कोमल के माता-िपता दहेज नहीं दे पाये,

तब िवपक्षी व उसके पिरवार वाले उसे तंग तराश व मारने पीटने लगे। जून 2020 में िवपक्षी ने दान दहेज को लेकर कोमल को मार-पीट कर घर से भगा िदया। कोमल अपने मायके में रह रही है। प्रितपरीक्षा में साक्षी ने कहा है िक कोमल उसकी िरश्ते में कुछ नहीं है। वह कोमल की िबरादरी का है। शादी में दान दहेज को लेकर कोई झगडा िववाद नहीं हुआ था। उसके सामने कोमल कभी मारी पीटी नहीं गई। कोमल िदनांक 01.06.2020 को आिखरी बार अपनी ससुराल से मायके आई थी और तब से ससुराल नहीं गई। डी०डब्लू०-01 कृष्ण कुमार गुप्ता ने सशपथ साक्ष्य में कहा है िक शादी में कोई दान दहेज की मांग नहीं हुई थी। उसने व उसके पिरवारवालों द्वारा िकसी प्रकार की परेशानी नहीं होने दी गई और न ही प्रतािड़त िकया गया। शादी के बाद कोमल ने उसके पिरवारवालों तथा माता-िपता के साथ काफी क् र ूता की। उसकी मां बीमार थी। वह मेहनत मजदूरी करके अपनी माता का इलाज करवाता था। यह बात उसकी पत्नी को नागवार लगती थी। उसकी पत्नी द्वारा कहा जाता था िक वह घर छोड़कर अलग रहे, िजससे पािरवािरक कलह उत्पन्न हो गई। िदनांक 10.06.2020 को शादी में िमला दहेज, जेवर तथा कीमती कपड़े व सारा सामान लेकर कोमल अपनी मां के साथ मायके चली गई। िदनांक 16.06.2020 को उभयपक्ष के बीच सुलह कराने का प्रयास िकया गया, लेिकन उसकी पत्नी व उनके पिरवारवालों द्वारा उसके साथ अभद्रता की गई, िजससे वह मानिसक रूप से आहत हो गया। दौरान इलाज उसकी मां की िदनांक 09.07.2020 को मृत्यु हो गई। मां की मृत्यु होने के बाद उसकी पत्नी कोमल न तो उसके घर आई, न ही मां के अिन्तम संस्कार में शािमल हुई। वह आवेिदका को मायके में गुजारा देने के िलए तैयार नहीं है। अपने साथ रखने के िलए तैयार है। प्रितपरीक्षा में साक्षी ने कहा है िक कोमल शादी में जब िवदा होकर उसके घर गई, तब दो महीना उसके घर रही। उस समय उसके व कोमल के बीच मधुर सम्बन्ध बना रहा। कहीं घुमने टहलने नहीं गये। उसकी व कोमल की शादी मानस होटल जो टामसन कालेज के पास है, से हुई थी। मानस होटल की बुिकग से लेकर खाना पीना व सारा इन्तजाम कोमल के माता-िपता द्वारा िकया गया था। कोमल उसके घर से िदनांक 10.06.2020 को चली गई, तब से उसके घर नहीं आई। क् र ू व्यवहार को गाली देना कहते हैं। कोमल उसके घर लगभग चौदह-पन्द्रह महीना रही। इस बीच उसने कोई िशकायती प्राथर्ना-पत्र थाने पर व िकसी उच्च अिधकारी को नहीं िदया। उसके व कोमल के बीच िदनांक 06.05.2020 को कोई समझौता नहीं हुआ। यिद कोमल उसके घर चलकर रहे, तो वह अपनी हैिसयत के अनुसार भरण-पोषण तथा खचार् देने के िलए तैयार है। उसकी मािसक आय पांच हजार रूपया है, उसी के मुतािबक वह रख पायेगा। जब से कोमल उसके घर से गई है, तब से आज तक कोमल को उसने िकसी प्रकार की भरण-पोषण धनरािश नहीं दी। डी०डब्लू०-02 िवनय प्रकाश ने सशपथ साक्ष्य में कहा है िक कृष्ण कुमार गुप्ता व उनके पिरवारवाले कोई दान दहेज की मांग नहीं करते थे, न ही कोमल को तंग तराश करते थे। कोमल माता-िपता से अलग रहना चाहती थी। कोमल शादी के तीन महीने बाद हँसी खुशी मायके चली गई। प्रितपरीक्षा में साक्षी ने कहा है िक वह कृष्ण कुमार गुप्ता का मौसा है। कृष्ण कुमार की शादी में वह उपिस्थत था। कोमल की िवदाई के समय मानस मैिरज हाल गोण्डा में फनीर्चर व इलेक्ट्रािनक का सामान उपहार स्वरूप कोमल गुप्ता के पिरवारवालों द्वारा कृष्ण कुमार गुप्ता को िदया गया था। नगद दहेज की कोई जानकारी उसे नहीं है। जो दहेज मांगने की बात उसने बताई है, वह कृष्ण कुमार गुप्ता से जानकारी के आधार पर बताई है। डी०डब्लू०-03 उमाशंकर ने सशपथ साक्ष्य में कहा है िक शादी के बाद कृष्ण कुमार कोमल से न तो दान दहेज मांगते थे, न ही कृष्ण कुमार के घरवाले दान दहेज की मांग करते थे और न ही

कोमल को दान दहेज के िलए परेशान करते थे। कृष्ण कुमार की मां बीमार रहती थी। दौरान बीमारी कोमल उन्हें देखने नहीं आई और न ही कृष्ण कुमार की मां के देहान्त के बाद आई। कोमल कहती थी िक बंटवारा करके अलग रहो। बंटवारा करके अलग न रहने पर िदनांक 10.06.2020 को कोमल कृष्ण कुमार के घर से जेवर, गहना व कपड़े आिद लेकर मायके चली गई। कोमल स्वतंत्र िमजाज की है और अकेले रहना चाहती है। प्रितपरीक्षा में साक्षी ने कहा है िक वह कृष्ण कुमार गुप्ता के नाना का भाई है। दान दहेज की जानकारी कृष्ण कुमार के माता-िपता के बताये जाने पर उसे हुई। उसे स्वयं दान दहेज के बारे में कोई जानकारी नहीं है। कोमल कृष्ण कुमार गुप्ता के घर से कब गई थी, उसे जानकारी नहीं है। उसने कोमल को कपड़ा, जेवर व गहने लेकर भागते नहीं देखा। उसने बयान में जो कहा है िक कोमल स्वतंत्र िमजाज की है और अकेले रहना चाहती है, यह बात कृष्ण कुमार के माता-िपता के बताने पर उसे पता चली। कोमल गुप्ता के पिरवारवालों द्वारा िवदाई में फनीर्चर व इलेक्ट्रािनक का सामान दान उपहार स्वरूप कृष्ण कुमार गुप्ता को िदया गया था, यह उसने देखा था। आवेिदका की ओर से पत्रावली में कागज सं०-16 ख/2 लगायत 16 ख/6 प्रमािणत प्रित आरोप-पत्र मु०अ०सं०-390/2020, धारा 498 A,323,504,506 आई.पी.सी. व 3/4 डी.पी.एक्ट दािखल िकया गया है, िजसके अवलोकन से िविदत होता है िक उक्त मामले में िवपक्षी कृष्ण कुमार तथा उनके िपता रामदीन के िवरूद्ध आरोप-पत्र सक्षम न्यायालय में दािखल िकया गया ह।ै

इस प्रकार उभयपक्ष की ओर से प्रस्तुत साक्ष्य के अवलोकन से स्पष्ट है िक आवेिदका ने िवपक्षी व उसके घरवालों द्वारा अितिरक्त दहजे की मांग को लेकर उसे शारीिरक व मानिसक रूप से प्रतािड़त िकया जाना कहा है और यह कहा है िक अितिरक्त दहेज की मांग को लेकर िवपक्षी व उसके घरवाले उसे प्रतािड़त करते थे। उसके मायकेवालों ने िवपक्षी को पल्सर मोटरसाइिकल खरीदने के िलए मु०-1,35,000/- रूपये िदये, लेिकन िवपक्षी ने मोटरसाइिकल न खरीदकर उक्त रूपया अपने व्यवसाय को बढ़ाने में लगा िदया और पुनः मोटरसाइिकल की मांग करने लगा। अितिरक्त दहेज की मांग पूरी न होने पर िवपक्षी ने िदनांक 10.06.2020 को उसका समस्त स्त्रीधन छीनकर मार-पीटक घर से िनकाल िदया। जबिक िवपक्षी का कहना है िक उसने व उसके घरवालों ने कभी भी आवेिदका से दहेज की मांग नहीं की। आवेिदका स्वयं कठोर व क् र ू मिहला है। उसने िवपक्षी से कहा िक वह अपने माता-िपता से बंटवारा करके अलग रहे। आवेिदका के दबाव में वह अपने माता-िपता से बंटवारा करके अलग रहने लगा। इसके बावजूद आवेिदका उसके माता-िपता के साथ क् र ूतापूणर् व्यवहार करती रही और िदनांक 10.06.2020 को अपनी मां को बुलाकर समस्त सामान, कीमती कपड़े व जेवरात लेकर मायके चली गई। िवपक्षी/डी०डब्लू०-01 कृष्ण कुमार गुप्ता ने आपित्त में कहा है िक अपनी पत्नी के दबाव में वह अपने माता-िपता से अलग रहने लगा। जबिक सशपथ साक्ष्य में डी०डब्लू०-01 कृष्ण कुमार ने यह कहा है िक उसकी पत्नी के द्वारा यह कहा जाता था िक वह घर छोड़कर अलग रहे, िजससे पािरवािरक कलह उत्पन्न हो गई और 10 जून 2020 को आवेिदका अपनी मां के साथ सारा सामान लेकर मायके चली गई। डी०डब्लू०-01 कृष्ण कुमार ने प्रितपरीक्षा में कहा है िक जब से कोमल उसके घर से गई है, तब से वह कोमल के घर नहीं गया है। वह कोमल को मायके में गुजारा भत्ता देने के िलए तैयार नहीं है। उसकी मािसक आय पांच हजार रूपया है, वह उसी के मुतािबक रख पायेगा। जब से कोमल उसके घर से मायके आई है, तब से आज तक उसने कोमल को िकसी प्रकार का भरण-पोषण व सामान नहीं िदया है। डी०डब्लू०-02 िवनय प्रकाश ने प्रितपरीक्षा में कहा है िक वह शादी में उपिस्थत था। कोमल

की िवदाई के समय फनीर्चर व इलेक्ट्रािनक का सामान कोमल के पिरवारवालों द्वारा िदया गया था। नगद दहेज की जानकारी उसे नहीं है। उसने बयान में जो दहेज वाली बात बताई है, वह कृष्ण कुमार गुप्ता से जानकारी के आधार पर बताई है। डी०डब्लू०-03 उमाशंकर ने भी प्रितपरीक्षा में कहा है िक कोमल स्वतंत्र िमजाज की है और अकेले रहना चाहती है, इस बात की जानकारी उसे कृष्ण कुमार के माता-िपता के बताने पर हुई थी। कोमल गुप्ता के पिरवारवालों द्वारा िवदाई के समय फनीर्चर व इलेक्ट्रािनक का सामान कृष्ण कुमार को िदया गया था। िजससे िवपक्षी का यह कथन गलत िसद्ध हो जाता है िक उसका िववाह िबना दान दहेज के हुआ था। आवेिदका के भाई पी०डब्लू०-02 गौतम गुप्ता ने भी साक्ष्य में कहा है िक उसने शादी के बाद िवपक्षी की मांग पर मु०-1,35,000/- रूपये पल्सर मोटरसाइिकल खरीदने के िलए िदया था। िवपक्षी द्वारा दहेज की मांग को लेकर आवेिदका को प्रतािड़त करके घर से िनकाल िदये जाने के कारण िवपक्षी व उसके घरवालों के िवरूद्ध दहेज उत्पीड़न का मुकदमा भी पंजीकृत कराया गया, िजसमें आरोप-पत्र सक्षम न्यायालय में दािखल हो चुका है। िवपक्षी द्वारा आवेिदका को िवदा कराकर अपने साथ रखने का कोई प्रयास िकया गया हो, इसका कोई साक्ष्य िवपक्षी द्वारा पत्रावली में दािखल नहीं िकया गया है। िजससे यह स्पष्ट पिरलिक्षत होता है िक िवपक्षी न तो आवेिदका को अपने साथ रखना चाहता है और न हीं उसका भरण-पोषण करना चाहता है। िवपक्षी द्वारा आवेिदका को अपने साथ रखकर उसका भरण-पोषण न करने के कारण मजबूरी में आवेिदका अपने मायके में रहकर उपेिक्षत जीवन व्यतीत कर रही है। ऐसी िस्थित में आवेिदका िवपक्षी से अलग रहते हुए भी भरण-पोषण भत्ता प्राप्त करने की अिधकािरणी है। जहां तक भरण-पोषण भत्ते की धनरािश का प्रश्न है? िवपक्षी मूंगफली तथा जूस का व्यवसाय करता है तथा िवपक्षी के पास पैतृक अचल सम्पित्त भी है, िजससे उसे पयार्प्त आय होती है। आवेिदका िवपक्षी की िववािहता पत्नी है। िवपक्षी का यह नैितक व िविधक दाियत्व है िक वह अपनी पत्नी का भरण-पोषण करे, लेिकन िवपक्षी आविदका का भरणे -पोषण नहीं कर रहा है। जब से आवेिदका मायके में रह रही है, तब से िवपक्षी ने आविदका को भरणे -पोषण हेतु कोई धनरािश नही दी और न ही दौरान मं ुकदमा कोई अन्तिरम भरण-पोषण भत्ता ही िदया है। अतः उभयपक्ष की पािरवािरक िस्थित, वतर्मान सामािजक पिरवश व मे ंहगाई की िस्थित को दृिषगत रखत्ट हे ुए आवेिदका को िवपक्षी से मु०-3500/- रूपये (तीन हजार पांच सौ रुपये) प्रितमाह भरण-पोषण भत्ता प्राथर्ना-पत्र प्रस्तुत करने की ितिथ 18.07.2022 से िदलाया जाना न्यायोिचत होगा। तद्रुसार प्राथर्ना-पत्र 3 क (दािण्डक प्रकीणर् वाद सं०-817/2022) आंिशक रूप से स्वीकार िकये जाने योग्य है।"

Impeaching the order under challenge, learned counsel for the revisionist states that the opposite party no. 2 is not entitled to the maintenance as awarded by the Family Court as she is an educated lady and she earns sufficient amount. However, to substantiate the same, no document has been placed on record.

It is also stated that the opposite party no. 2, on her own volition, left the matrimonial home as such, she is not entitled to the amount towards maintenance in exercise of power under Section 125 Cr.P.C.

Learned counsel for the opposite party no. 2 opposing the present revision stated that just to avoid the payment of the amount awarded by the Family Court vide order dated 23.08.2024, under challenge, the present revision has been filed.

It is also stated that on account of ill-treatment by the revisionist, the opposite party no. 2 was compelled to left the matrimonial house and as such, she is entitled to the amount of maintenance awarded by the Family Court.

It is also stated that the amount awarded by the Family Court is a meager amount and a normal person cannot survive with this amount.

Considered the aforesaid and perused the records.

On the subject matter of this case, it would be apt to refer the observations made by the Hon'ble Apex Court in relation to dealing with the applications under Section 125 Cr.P.C.

The Hon'ble Apex Court in the case of Anju Garg and another vs. Deepak Kumar Garg , reported in 2022 SCC OnLine SC 1314 , observed as under:-

"9. At the outset, it may be noted that Section 125 of Cr.P.C. was conceived to ameliorate the agony, anguish and financial suffering of a woman who is required to leave the matrimonial home, so that some suitable arrangements could be made to enable her to sustain herself and the children, as observed by this Court in Bhuwan Mohan Singh v. Meena (2015) 6 SCC 353 . This Court in the said case, after referring to the earlier decisions, has reiterated the principle of law as to how the proceedings under Section 125 Cr.P.C have to be dealt with by the Court. It held as under:

"In Dukhtar Jahan v. Mohd. Farooq [(1987) 1 SCC 624 : 1987 SCC (Cri) 237] the Court opined that : (SCC p. 631, para 16)

16. "… Proceedings under Section 125 [of the Code], it must be remembered, are of a summary nature and are intended to enable destitute wives and children, the latter whether they are legitimate or illegitimate, to get maintenance in a speedy manner."

8. A three-Judge Bench in Vimala (K.) v. Veeraswamy (K.) [(1991) 2 SCC 375 : 1991 SCC (Cri) 442], while discussing about the basic purpose under Section 125 of the Code, opined that : (SCC p. 378, para 3)

3. "Section 125 of the Code of Criminal Procedure is meant to achieve a social purpose. The object is to prevent vagrancy and destitution. It provides a speedy remedy for the supply of food, clothing, and shelter to the deserted wife."

9. A two-Judge Bench in Kirtikant D. Vadodaria v. State of Gujarat [(1996) 4 SCC 479 : 1996 SCC (Cri) 762] , while adverting to the

dominant purpose behind Section 125 of the Code, ruled that : (SCC p. 489, para 15)

15. "… While dealing with the ambit and scope of the provision contained in Section 125 of the Code, it has to be borne in mind that the dominant and primary object is to give social justice to the woman, child and infirm parents, etc. and to prevent destitution and vagrancy by compelling those who can support those who are unable to support themselves but have a moral claim for support. The provisions in Section 125 provide a speedy remedy to those women, children and destitute parents who are in distress. The provisions in Section 125 are intended to achieve this special purpose. The dominant purpose behind the benevolent provisions contained in Section 125 clearly is that the wife, child and parents should not be left in a helpless state of distress, destitution and starvation."

10. In Chaturbhuj v. Sita Bai [(2008) 2 SCC 316 : (2008) 1 SCC (Civ) 547 : (2008) 1 SCC (Cri) 356] , reiterating the legal position the Court held : (SCC p. 320, para 6)

6. "… Section 125 CrPC is a measure of social justice and is specially enacted to protect women and children and as noted by this Court in Capt. Ramesh Chander Kaushal v. Veena Kaushal [(1978) 4 SCC 70 : 1978 SCC (Cri) 508] falls within constitutional sweep of Article 15(3) reinforced by Article 39 of the Constitution of India. It is meant to achieve a social purpose. The object is to prevent vagrancy and destitution. It provides a speedy remedy for the supply of food, clothing and shelter to the deserted wife. It gives effect to fundamental rights and natural duties of a man to maintain his wife, children and parents when they are unable to maintain themselves. The aforesaid position was highlighted in Savitaben Somabhai Bhatiya v. State of Gujarat [(2005) 3 SCC 636 : 2005 SCC (Cri) 787] ."

11.Recently in Nagendrappa Natikar v. Neelamma [(2014) 14 SCC 452 : (2015) 1 SCC (Cri) 407 : (2015) 1 SCC (Civ) 346] , it has been stated that it is a piece of social legislation which provides for a summary and speedy relief by way of maintenance to a wife who is unable to maintain herself and her children".

10. This Court had made the above observations as the Court felt that the Family Court in the said case had conducted the proceedings without being alive to the objects and reasons, and the spirit of the provisions under Section 125 of the Code. Such an impression has also been gathered by this Court in the case on hand. The Family Court had disregarded the basic canon of law that it is the sacrosanct duty of the

husband to provide financial support to the wife and to the minor children. The husband is required to earn money even by physical labour, if he is an able-bodied, and could not avoid his obligation, except on the legally permissible grounds mentioned in the statute. In Chaturbhuj v. Sita Bai (2008) 2 SCC 316 , it has been held that the object of maintenance proceedings is not to punish a person for his past neglect, but to prevent vagrancy and destitution of a deserted wife, by providing her food, clothing, and shelter by a speedy remedy. As settled by this Court, Section 125 Cr.P.C. is a measure of social justice and is specially enacted to protect women and children. It also falls within the Constitutional sweep of Article 15(3), reinforced by Article 39 of the Constitution of India."

In the case of Sanjeev Kapoor vs. Chandana Kapoor and others , reported in (2020) 13 SCC 172 , the Hon'ble Apex Court while considering the applicability of Section 362 Cr.P.C. in relation to the proceedings/case instituted under Section 125 Cr.P.C., on the "aims and objects" of Section 125 Cr.P.C., observed as under:-

"23. Before we proceed to look into the legislative scheme of Section 125 CrPC, we need to notice few rules of interpretation of statutes when the court is concerned with the interpretation of a social justice legislation. Section 125 CrPC is a social justice legislation which orders for maintenance for wives, children and parents. Maintenance of wives, children and parents is a continuous obligation enforced. This Court had occasion to consider the interpretation of Section 125 CrPC in Badshah v. Urmila Badshah Godse [Badshah v. Urmila Badshah Godse, (2014) 1 SCC 188 : (2014) 1 SCC (Civ) 51] . In paras 13.3 to 18, the following has been laid down: (SCC pp. 196-98)

"13.3. Thirdly, in such cases, purposive interpretation needs to be given to the provisions of Section 125 CrPC. While dealing with the application of a destitute wife or hapless children or parents under this provision, the Court is dealing with the marginalised sections of the society. The purpose is to achieve "social justice" which is the constitutional vision, enshrined in the Preamble of the Constitution of India. The Preamble to the Constitution of India clearly signals that we have chosen the democratic path under the rule of law to achieve the goal of securing for all its citizens, justice, liberty, equality and fraternity. It specifically highlights achieving their social justice. Therefore, it becomes the bounden duty of the courts to advance the cause of the social justice. While giving interpretation to a particular provision,

the court is supposed to bridge the gap between the law and society.

¶63

14. Of late, in this very direction, it is emphasised that the courts have to adopt different approaches in "social justice adjudication", which is also known as "social context adjudication" as mere "adversarial approach" may not be very appropriate. There are number of social justice legislations giving special protection and benefits to vulnerable groups in the society. Prof. Madhava Menon describes it eloquently:

'It is, therefore, respectfully submitted that "social context judging" is essentially the application of equality jurisprudence as evolved by Parliament and the Supreme Court in myriad situations presented before courts where unequal parties are pitted in adversarial proceedings and where courts are called upon to dispense equal justice. Apart from the social-economic inequalities accentuating the disabilities of the poor in an unequal fight, the adversarial process itself operates to the disadvantage of the weaker party. In such a situation, the Judge has to be not only sensitive to the inequalities of parties involved but also positively inclined to the weaker party if the imbalance were not to result in miscarriage of justice. This result is achieved by what we call social context judging or social justice adjudication. 15. The provision of maintenance would definitely fall in this category which aims at empowering the destitute and achieving social justice or equality and dignity of the individual. While dealing with cases under this provision, drift in the approach from "adversarial" litigation to social context adjudication is the need of the hour.

16. The law regulates relationships between people. It prescribes patterns of behaviour. It reflects the values of society. The role of the court is to understand the purpose of law in society and to help the law achieve its purpose. But the law of a society is a living organism. It is based on a given factual and social reality that is constantly changing. Sometimes change in law precedes societal change and is even intended to stimulate it. In most cases, however, a

change in law is the result of a change in social reality. Indeed, when social reality changes, the law must change too. Just as change in social reality is the law of life, responsiveness to change in social reality is the life of the law. It can be said that the history of law is the history of adapting the law to society's changing needs. In both constitutional and statutory interpretation, the court is supposed to exercise discretion in determining the proper relationship between the subjective and objective purposes of the law.

¶70

17. Cardozo acknowledges in his classic [ Benjamin N. Cardozo, The Nature of Judicial Process (Yale University Press, New Haven, 1921).]

'… no system of jus scriptum has been able to escape the need of it.'

and he elaborates:

¶73

'It is true that codes and statutes do not render the Judge superfluous, nor his work perfunctory and mechanical. There are gaps to be filled. … There are hardships and wrongs to be mitigated if not avoided. Interpretation is often spoken of as if it were nothing but the search and the discovery of a meaning which, however obscure and latent, had nonetheless a real and ascertainable pre-existence in the legislator's mind. The process is, indeed, that at times, but it is often something more. The ascertainment of intention may be the least of a Judge's troubles in ascribing meaning to a statute.

Says Gray in his lectures [ John Chipman Gray, The Nature and Sources of the Law.] :

¶75

"The fact is that the difficulties of so-called interpretation arise when the legislature has had no meaning at all; when the question which is raised on the statute never occurred to it; when what the Judges have to do is, not to determine that the legislature did mean on a point which was present to its mind, but to guess what it would have intended on a point not present to its mind, if the point had been present."'

¶76

18. The court as the interpreter of law is supposed to supply omissions, correct uncertainties, and harmonise results with justice through a method of free decision — libre recherché scientifique i.e. "free scientific research". We are of the opinion that there is a non-rebuttable presumption that the legislature while making a provision like Section 125 CrPC, to fulfil its constitutional duty in good faith, had always

intended to give relief to the woman becoming "wife" under such circumstances. This approach is particularly needed while deciding the issues relating to gender justice. We already have examples of exemplary efforts in this regard. Journey from Shah Bano [Mohd. Ahmed Khan v. Shah Bano Begum, (1985) 2 SCC 556 : 1985 SCC (Cri) 245] to Shabana Bano [Shabana Bano v. Imran Khan, (2010) 1 SCC 666 : (2010) 1 SCC (Civ) 216 : (2010) 1 SCC (Cri) 873] guaranteeing maintenance rights to Muslim women is a classical example.

¶80

24. The closer look at Section 125 CrPC itself indicates that the court after passing judgment or final order in the proceedings under Section 125 CrPC does not become functus officio. The section itself contains express provisions where order passed under Section 125 CrPC can be cancelled or altered which is noticeable from Sections 125(1), 125(5) and 127 CrPC, which are to the following effect:

"125. Order for maintenance of wives, children and parents.— (1) If any person having sufficient means neglects or refuses to maintain— (a) his wife, unable to maintain herself, or (b) his legitimate or illegitimate minor child, whether married or not, unable to maintain itself, or

(c) his legitimate or illegitimate child (not being a married daughter) who has attained majority, where such child is, by reason of any physical or mental abnormality or injury unable to maintain itself, or

¶83

(d) his father or mother, unable to maintain himself or herself

,

¶85

a Magistrate of the First Class may, upon proof of such neglect or refusal, order such person to make a monthly allowance for the maintenance of his wife or such child, father or mother, at such monthly rate, as such Magistrate thinks fit, and to pay the same to such person as the Magistrate may from time to time direct: Provided that the Magistrate may order the father of a minor female child referred to in clause (b) to make such allowance, until she attains her majority, if the Magistrate is satisfied that the husband of such minor female child, if married, is not possessed of sufficient means:

Provided further that the Magistrate may, during the pendency of the proceeding regarding monthly allowance for the maintenance under this sub-section, order such person to make a monthly allowance for the interim maintenance of his

wife or such child, father or mother, and the expenses of such proceeding which the Magistrate considers reasonable, and to pay the same to such person as the Magistrate may from time to time direct:

Provided also that an application for the monthly allowance for the interim maintenance and expenses for proceeding under the second proviso shall, as far as possible, be disposed of within sixty days from the date of the service of notice of the application to such person. Explanation.—For the purposes of this Chapter—

(a) "minor" means a person who, under the provisions of the Indian Majority Act, 1875 (9 of 1875) is deemed not to have attained his majority;

(b) "wife" includes a woman who has been divorced by, or has obtained a divorce from, her husband and has not remarried.

(5) On proof that any wife in whose favour an order has been made under this section is living in adultery, or that without sufficient reason she refuses to live with her husband, or that they are living separately by mutual consent, the Magistrate shall cancel the order.

127. Alteration in allowance.— (1) On proof of a change in the circumstances of any person, receiving, under Section 125 a monthly allowance for the maintenance or interim maintenance, or ordered under the same section to pay a monthly allowance for the maintenance, or interim maintenance, to his wife, child, father or mother, as the case may be, the Magistrate may make such alteration, as he thinks fit, in the allowance for the maintenance or the interim maintenance, as the case may be.

¶97

(2) Where it appears to the Magistrate that, in consequence of any decision of a competent civil court, any order made under Section 125 should be cancelled or varied, he shall cancel the order or, as the case may be, vary the same accordingly.

¶98

(3) Where any order has been made under Section 125 in favour of a woman who has been divorced by, or has obtained a divorce from, her husband, the Magistrate shall, if he is satisfied that—

(a) the woman has, after the date of such divorce, remarried,

cancel such order as from the date of her remarriage.

¶103

(b) the woman has been divorced by her husband and that she has received, whether before or after the date of the said order, the whole of the sum which, under any customary or personal law applicable to the parties, was payable on such divorce, cancel such order—

¶104

(i) in the case where such sum was paid before such order, from the date on which such order was made,

¶105

(ii) in any other case, from the date of expiry of the period, if any, for which maintenance has been actually paid by the husband to the woman;

¶106

(c) the woman has obtained a divorce from her husband and that she had voluntarily surrendered her rights to maintenance or interim maintenance, as the case may be after her divorce, cancel the order from the date thereof. (4) At the time of making any decree for the recovery of any maintenance or dowry by any person, to whom monthly allowance for the maintenance and interim maintenance or any of them has been ordered to be paid under Section 125, the civil court shall take into account that sum which has been paid to, or recovered by, such person as monthly allowance for the maintenance and interim maintenance or any of them, as the case may be, in pursuance of the said order."

25. In Section 125 CrPC the expression used is "as the Magistrate may from time to time direct". The use of the expression "from time to time" has purpose and meaning. It clearly contemplates that with regard to the order passed under Section 125(1) CrPC, the Magistrate may have to exercise jurisdiction from time to time. Use of the expression "from time to time" is in exercise of jurisdiction of the Magistrate in a particular case. Advanced Law Lexicon by P. Ramanatha Aiyar, 3rd Edn. defines "time to time" as follows:

"Time to time. As occasion arises."

26. The above legislative scheme indicates that the Magistrate does not become functus officio after passing an order under Section 125 CrPC, as and when the occasion arises the Magistrate exercises the jurisdiction from time to time. By Section 125(5) CrPC, the Magistrate is expressly empowered to cancel an order passed under Section 125(1) CrPC on fulfilment of certain conditions.

27. Section 127 CrPC also discloses the legislative intendment where the

Magistrate is empowered to alter an order passed under Section 125 CrPC. Sub-section (2) of Section 127 CrPC also empowers the Magistrate to cancel or vary an order under Section 125. The legislative scheme as delineated by Sections 125 and 127 CrPC as noted above clearly enumerated the circumstances and incidents provided in the Code of Criminal Procedure where the court passing a judgment or final order disposing of the case can alter or review the same. The embargo as contained in Section 362 is, thus, clearly relaxed in the proceedings under Section 125 CrPC as indicated above.

¶114

28. The submissions which have been pressed by the learned counsel for the appellant were founded only on embargo of Section 362 and when embargo of Section 362 is expressly relaxed in the proceedings under Section 125 CrPC, we are not persuaded to accept the submission of the counsel for the appellant that the Family Court was not entitled to set aside and cancel its order dated 6-5-2017 in the facts and circumstances of the present case."

¶115

In the case of Chander Parkash Bodh Raj vs. Shila Rani Chander Prakash: 1968 SCC Online Del 52 , the Delhi High Court has held that :

¶116

"an able-bodied young man has to be presumed to be capable of earning sufficient money so as to be able to reasonably maintain his wife and child and he cannot be heard to say that he is not in a position to earn enough to be able to maintain them according to the family standard. It is for such able-bodied person to show to the Court cogent grounds for holding that he is unable, for reasons beyond his control, to earn enough to discharge his legal obligation of maintaining his wife and child."

The Hon'ble Apex Court in the case of Rajnesh vs. Neha , (2021) 2 SCC 324 : (2021) 2 SCC (Civ) 220 : 2020 SCC OnLine SC 903 at page 347 has approved the above law laid down by the Delhi High Court.

¶118

The Hon'ble Apex Court in Kulbhushan Kumar Vs. Raj Kumari, (1970) 3 SCC 129 has held that 25% of the husband's net salary would be just and proper to be awarded as maintenance allowance to the wife. The amount of permanent alimony awarded to the wife must be befitting the status of the parties and the financial capacity of the husband to make the payment.

In Kalyan Dey Chaudhary Vs. Rita Dey Chaudhary Nee Nandy, (2017) 14 SCC 200, the Hon'ble Apex Court has followed the quantum of maintenance fixed by the Hon'ble Apex Court in Kulbhushan Kumar (supra) that 25% of net income of the husband should be paid to the wife as maintenance.

Considering the aforesaid including the meagre amount awarded by the Family

Court i.e. 3,500/- per month from 29.09.2020, the date of filing of application, and also the law down by the Hon'ble Apex Court in the judgments, referred above, as also that on account of harassment/cruelty/ill-treatment committed by the in-laws also by the revisionist the opposite party no.2 was compelled to lodge an FIR, registered as Case Crime no.390/2020 and in the said case charge sheet was filed, which indicates that under compelling circumstances, the opposite party no.2 left her matrimonial house and also that allegations that the opposite party no.2 earns sufficient amount have not been established/proved by the revisionist before the Family Court, this Court finds no illegality, irregularity, or jurisdictional error in the order impugned dated 23.08.2024.

¶124

The instant revision is accordingly dismissed . No order as to costs.

¶125

Interim order, if any, stands vacated.

¶126

The copy of the order be sent to the Family Court forthwith.
