This Court had passed the following order on 25.05.2024:-

"Heard learned counsel for the petitioner, learned A.G.A. for the State/Respondents and perused the record.

This petition seeks issuance of direction in the nature of certiorari quashing the impugned FIR dated 05.03.2023 bearing FIR/Case Crime No.0053 of 2023 under Sections 323, 504, 506, 467, 468 & 471 I.P.C., registered at Police Station Mahanagar District Lucknow (Central Commissionerate Lucknow).

Learned counsel for the petitioner submits that petitioner is innocent. She has falsely been implicated in the case. The loan was duly given by the bank. There is no objection alleged against documents. In fact, after obtaining the loan from the bank, informant was unable to clear the loan hence this FIR with false contention.

A case for consideration is made out.

Issue notice to opposite party No. 4.

Let the pleadings be exchanged within four weeks.

Considering the submissions made, it is provided that till the next date of listing, petitioner shall not be arrested in pursuance to the First Information Report Dated 05.03.2023 bearing FIR/Case Crime No.0053 of 2023 under Sections 323, 504, 506, 467, 468 & 471 I.P.C., registered at Police Station Mahanagar District Lucknow (Central Commissionerate Lucknow) The petitioner shall, however, cooperate in the investigation and get her statements recorded before the Investigating Officer as and when she is called. If she does not do so then it can be a ground for seeking vacation of this interim order. "

Learned A.G.A., on the basis of counter affidavit, which has been filed today and taken on record, submits that name of the petitioner has been dropped and final report has been filed against her whereas charge sheet has been filed against other accused, therefore, this petition has rendered infructuous.

Sri Prem Prakash Giri, holding brief of Sri Suresh Chandra Pandey, learned counsel for the petitioner does not dispute the aforesaid contention of learned A.G.A.

Dismissed accordingly.

Interim order, if any, stands vacated.
