Learned counsel for the petitioner submits that the petitioner on being aggrieved by the order dated 09.10.2025 passed by the respondent no.3 (Additional Police Commissioner Commissionerate, Ghaziabad, District Ghaziabad) in Case No.99 of 2025 (State Vs. Abdul Kalam) under Section 2/3 of Uttar Pradesh Control of Goonda Act, 1970, Police Station Vijay Nagar, District Ghaziabad, has moved the appeal before respondent no.2 (Divisional Commissioner, Meerut Division, Meerut) on 15.10.2025. The petitioner is aggrieved that neither the appeal has been decided nor the stay application has been taken into consideration by the respondent no.2. Hence, the present writ petition.

Learned A.G.A. has opposed the writ petition.
