Sri Pramod Kumar Dwivedi, learned counsel for the petitioner appears and submits that the present writ petition has been moved with a innocuous prayer of early disposal of Case No. 165/XI of 2024 (Dhanraj Vs. Rajkaran), under Section 164 B.N.S.S. pending before respondent no.2/ Sub Divisional Magistrate, Tehsil Atarra, District Banda since 13.11.2024 and no effective order has been passed by respondent no.2 till date.

Learned AGA is present for the State-opposite party no.1.

There is no point in issuing notice to opposite party no.3 as the innocuous prayer of early disposal of the case has been made by learned counsel for the petitioner.

Considering the argument raised by learned counsel for the petitioner, the writ petition is disposed of with a direction to respondent no.2/Sub Divisional Magistrate, Tehsil Atarra, District Banda to disposed of the Case No. 165/XI of 2024 (Dhanraj Vs. Rajkaran), under Section 164 B.N.S.S. at an early date if possible within three months from today, if there is no legal impediment in deciding the same.
