Sri G.S.Chauhan, Advocate appears and submits that he is private counsel engaged by Gram Pradhan. The Gram Pradhan is not a party to the writ petition. On query, he submits that interest is being watched by the Gram Pradhan.

Sri Saroj Kumar Yadav, learned counsel holding brief appears for the petitioners and submits that by virtue of notice dated 29.09.2025, the respondent no.3./ Deputy Collector/ Sub Divisional Magistrate, Atrauli, Aligarh has directed the petitioner to remove the encroachment on the public land, as is intimated by the Gram Pradhan that in pursuance of orders dated 13.03.2008 and 05.09.2008, the encroachment has not been removed. It is directed to be removed by 03.10.2025. Hence the petitioner before the Court to issue directions under Article 227 of the Constitution of India to quash the said notice as the orders passed on 13.03.2008 and 05.09.2008 have already been complied.

Learned AGA is present for the State-opposite party no.1.

Sri Ravindra Prasad, learned counsel holding the brief appears on behalf of respondent no.5 (Land Management Committee, Gaon Sabha, Bhojpur and submits that he may be granted time to seek instruction.

This Court has gone through notice dated 29.09.2025, which is reiterated underneath :-

क्रम में न्यायालय परगना मिजस्ट्रेट अतरौली जनपद अलीगढ़ द्वारा धारा 133 दं०प्र०संिहता के अन्तगर्त बेदखली आदेश आदेश िदनांक 13.03.2008 व आदेश िदनांक 05.09.2008 को पािरत िकया गया है। ग्राम प्रधान द्वारा उपिस्थत होकर अवगत कराया है िक न्यायालय से बेदखली का आदेश पािरत हो जाने के उपरान्त भी आपके द्वारा अपना अितक्रमण आज िदनांक तक नहीं हटाया गया है। इसप्रकार आपके द्वारा माननीय न्यायालय के आदेश की स्पष्ट अवहेलना की जा रही है।

अतः उपरोक्त को दृिष्टगत रखते हुए आपको िनदेर्िशत िकया जाता है िक आप मा० न्यायालय के आदेश के अनुक्रम में अपना अितक्रमण िदनांक 03.10.2025 तक स्वयं हटा लें। अन्यथा की दशा में आपका अितक्रमण बलपूवर्क हटवा िदया जायेगा। यिद उक्त के सम्बन्ध में आप अपना पक्ष रखना चाहते हैं, तो समस्त साक्ष्यों सिहत िदनांक 03.10.2025 की प्रातः 11.00 बजे अधोहस्ताक्षरी के समक्ष उपिस्थत होकर रख सकते हैं।"

The bare perusal of the notice reveals that respondent no.3/Deputy Collector/ Sub Divisional Magistrate, Atrauli, Aligarh has issued noticed under influence of Gram Pradhan as is mentioned in the notice itself and without verifying the record whether the orders dated 13.03.2008 and 05.09.2008 have been complied with or not, the notice has been sent on the intimation given by the Gram Pradhan and there is a direction to the petitioners to remove the encroachment. Meaning thereby the respondent no.3 without calling for report about the veracity of the fact of encroachment, has issued directions for removal of encroachment. This notice is itself bad in the eye of law as issued after 17 years of the orders passed on 13.03.2008 and 05.09.2008, hence the notice dated 29.09.2025 is hereby quashed .

The respondent no.3/Deputy Collector/ Sub Divisional Magistrate, Atrauli, Aligarh may hold an inquiry into the compliance or non compliance of the aforesaid orders and pass appropriate order as fresh.

With this observation, the present writ petition is disposed of .
