By means of this petition, the petitioners have sought quashing of F.I.R. dated 15.03.2024 bearing Case Crime/FIR No.0118/2024, for the offence under Section 366 I.P.C., registered at Police Station Sakaran,

District Sitapur.

Learned counsel for the petitioners says that the girl has been given an affidavit before the Superintendent of Police, Sitapur that she has gone away from her house being fed-up with the atrocities of her family members and that she had gone to the petitioner's place on her own free will. She is at present residing at Lucknow, therefore, no offence is made out under Section 366 IPC. Issue notice to opposite party Nos.4 & 5.

Let learned AGA seek instructions in the matter or file affidavit of the Investigating Officer. List this case on 25.04.2024.

In the meantime, the girl may appear before the Investigating Officer and get her statement recorded. The Superintendent of Police, Sitapur shall also see as to whether any such affidavit has been given by the girl of her own free will, and if, it is her own statement that she has gone away on her own, then petitioners shall not be arrested. However, if the evidence is otherwise, then the benefit of this order shall not be available to them. Petitioners should also get their statement recorded before the Investigating Officer. Petitioners offer to produce the girl before the Investigating Officer."

Learned A.G.A. on the basis of counter affidavit filed today, which is taken on record, submits that final report no.05 of 2024 dated 05.04.2025 has been forwarded in the matter, therefore, this petition has rendered
