Heard Sri Rakesh Kumar Nayak, learned counsel for the petitioner and learned AGA.

This petition has been filed with the following prayers:

"(i) Issue an appropriate writ, order or direction in the nature of mandamus commanding the opposite parties to close the History Sheet No.30A, Police Station Bewana, District Ambedkar Nagar, which is still opened against the petitioner.

(ii) Issue an appropriate writ, order or direction in the nature of mandamus commanding the opposite parties not to interfere in the personal life of the petitioner and his family members and to protect the life and liberty of the petitioner.

(iii) Issue an appropriate writ, order or direction in the nature of mandamus commanding the opposite parties not to carry out night surveillance on the petitioner and his family members and not encroach upon the privacy of the petitioner and his family members."

3.Learned counsel for the petitioner submits that no case pending against the petitioner, even then the history sheet No.30A, Police Station Bewana, District Ambedkar Nagar has been opened against the petitioner and surveillance is still going on and the petitioner is being harassed. He further submits that the petitioner made two representations to the Superintendent of Police, Ambekdar Nagar on 15.11.2023 and

21.01.2024, contained in Annexure Nos. 4 and 5 to the petition respectively but till date the same has neither been considered nor the same has been disposed of. Thus, he makes an innocuous prayer for a direction for disposal of the representation.

4.Learned AGA opposed the submissions of learned counsel for the petitioner and submits that it has been disclosed in paragraph 12 of the counter affidavit that the petitioner is not being harassed. However, he submits that the representation made by the petitioner may be directed to be considered by the concerned authority in accordance with law, as the Superintendent of Police/respondent no.2 is empowered to take appropriate decision in the matter.

5.In view of above, without entering into the merits of the case, the petition is disposed of with direction to the respondent no.2/ Superintendent of Police, District Ambedkar Nagar to consider and dispose of the representation of the petitioner dated 21.01.2024 contained in Annexure No.5 to the petition expeditiously, say within a period of four weeks from the date of production of certified copy of this order and communicate the same to the petitioner forthwith.
