The present appeal under Section 14-A(1) of the SC/ST Act has been filed against the impugned order dated 30.07.2024 passed by Special Judge, SC/ST (PA), Gonda in Misc. Criminal Case No.192/2024 by which the application filed by the appellant under Section 156 (3) Cr.P.C. has been rejected. The operative part of the impugned order is extracted below:-

A perusal of the record so also the impugned order shows that no photograph of the alleged incident has been filed by the appellant. There is no witness to the occurrence although it is stated in the application under Section 156 (3) Cr.P.C. that house of the appellant was set on fire and upon alarm being raised, several persons came on the spot still there is no witness to the incident. Record further shows that Jitendra Kumar, who is respondent No.7 has lodged an FIR which is registered as Case Crime No.107 of 2024 against the appellant under Sections 323, 504, 506, 341 IPC read with Clause (v) of Section 3(2) of the SC/ ST Act. It appears that in order to exert pressure, the application under Section 156(3) Cr.P.C. has been given subsequently hence, I do find any illegality in the order impugned, the appeal being devoid of merit is accordingly dismissed.
