1.The petition has been filed under Section 482 CrPC for setting aside order dated 31.8.2024 passed by Addl. Civil Judge (Senior Division), Fourth/ACJM, Ayodhya in complaint case No.2212 of 2024 Mohd. Azam Kadri versus Rais Ahmad and another, P.S. Ram Janam Bhumi, District Ayodhya.

2.Heard learned counsel for the petitioner and learned A.G.A. for the State. Notice to private respondents is dispensed with in view of the proposed order.

3.Relevant part of the order dated 31.8.2024 (supra) is extracted as below :

"5. थथानथा कको० नगर ककी पपुललिस दथारथा जथाजांच कके उपरथाजांत पथायथा गयथा कक आवकेदक मको० जम कथादररी कके धथारथा 156 (3) दजां०प्र०सजां० कके अजांतगरत प्रस्तपुत प्रथाथरनथापत्र पर न्यथाबथालिय मम भकेजरी गई ररपकोरर पर प्रथाथर्थी कके प्रथाथरनथापत्र मम अजांककत कथनन कके सजांबजांध मम थथानथा स्थथानरीय पर ककोई अकभयकोग प ज ांरीककत नहहीं हहै।

6.प्रश्नगत कलथत घरनथा सके सजांबजांलधत उपरकोक्त तथ्यन व पररसस्थकतयन मम समपुकचत प्रतरीत हकोतथा हहै कक प्रथाथर्थी मको०

आजम कथादररी कको मथामलिके कके तथ्यन एवजां पररसस्थकतयन ककी जथानकथाररी हहै लजसके वह न्यथायथालिय कके समक्ष सथाक्ष्यन सके सथाकबत कर सकतथा हहै। उलकेखनरीय हहै कक धथारथा 156 (3) दजां०प्र०सजां० कके अजांतगरत प्रस्तपुत ककयके गयके प्रथाथरनथापत्र पर प्रथम ससूचनथा ररपकोरर अजांककत करनके व कववकेचनथा करनके कथा कनदरश पपुललिस कको कदयथा जथानथा कवलधक दृकष्टि सके मलजस्रटकेर कके ललिए अकनवथायर नहहीं हहै अकपतपु मलजस्रटकेर समपुकचत तथ्यन व पररसस्थकतयन मम इस प्रकथार कके प्रथाथरनथापजांत्र कको पररवथाद कके रूप मम भरी प ज ांरीककत कर सकतथा हहै और तदनपुसथार पररवथाद ककेस कके ललिए कवकडित प्रकक्रियथा कथा अनपुसरण करतके हहए उसककी सपुनवथाई /कनस्तथारण पररवथाद कके रूप मम भरी कर सकतथा हहै जहैसथा कक उपरकोक्त आशय कवलधक दृष्टिथाजांत कनम्नथाजांककत व्यवस्थथाओजां मम कदयथा गयथा हहै-

(i) नथाथसूलिथालि गजांगवथार प्रकत उत्तर प्रदकेश रथाज्य 2008 (61) ए०सरी०सरी० 792, (इलिथाहथाबथाद)

(ii) रथामबथाबसू ग प ुथा एवजां अन्य बनथाम उत्तर प्रदकेश रथाज्य , 2001(43) ए सरी सरी 50 (इलिथाहथाबथाद) (पसूणर परीठ)

(iii) फथादर थथॉमस बनथाम उत्तर प्रदकेश रथाज्य, 2011 (72) ए सरी सरी (इलिथाहथाबथाद) (पसूणर परीठ)

(iv) सपुखबथासरी बनथाम उत्तर प्रदकेश रथाज्य, 2007 (59) ए सरी सरी 739 (इलिथाहथाबथाद) (खण्डिपरीठ)

प्रथाथर्थी कथा प्रथाथरनथापत्र पररवथाद कके रूप मम दजर रलजस्रर हको। आवकेदक दथारथा पत्रथावलिरी पर धथारथा 202 दजां०प्र०सजां० कके अन्तगरत सथाकक्षयन ककी ससूकच भरी दथालखलिजां ककी जथाए। पत्रथावलिरी वथास्तके बयथान अन्तगरत धथारथा 200 दजां०प्र०सजां० कदनथाजांक 18.09.2024 कको पकेश हको।"

4.A perusal of the record shows that in the complaint, it has been averred by the applicant that the applicant is General Secretary of Anjuman Mohafiz Masazid & Maqavir Committee. He is also aware of Khasra number and chak number as also registration number of the masque. The applicant is also acquainted as to who has committed criminal conspiracy, i.e. Raees Ahmad and Noor Ala alias Chand as also the consideration amount given on 1.9.2023 to the tune of Rs.15 lacs and after receiving that amount, the said property has been sold to Ramjanm Bhumi Tirth through its Secretary Champatrai son of late Rameshwar Prasad. Thus, the entire facts regarding the alleged offence are in the knowledge of the applicant. Considering these aspects, the trial court has recorded a finding that since the applicant is aware of aforesaid facts, he can prove it in the complaint case and accordingly has registered the application moved by the applicant under section 156(3) CrPC as a complaint case.

5.I find no illegality in the order impugned. The petition, being devoid of merit, is dismissed.
