Learned counsel for respondent no.2 has filed a compliance/counter affidavit, which is taken on record.

Learned counsel for respondent has submitted that there is an interim order only to the extent that no recovery shall be initiated from the pensionary benefits of the applicant and in pursuance thereof, no recovery has been made from the pensionary benefits of the applicant.

It has been asked from the learned counsel for applicant whether any recovery was made from the pensionary benefits of the applicant after passing of the interim order, he has very fairly submitted that after that no recovery has been made but the part of the gratuity has yet not been paid.

In view of the facts and discussion made hereinabove, the present contempt application is devoid of merit and is dismissed , accordingly.

Notice issued earlier, if any, stands discharged.
