Heard learned counsel for the applicant as well as learned AGA for the State.Counter filed by the State is taken on record.

The applicant seeks enlargement on bail in Case Crime No. 681/2021, under Sections 302, 201 IPC, Police Station - Hargoun, District - Sitapur.

Learned counsel for the applicant submits that in terms of the FIR it was alleged that the brother of the informant was killed by his second wife and children. As per post mortem report, cause of death is antemortem injury and nine injuries were observed on the body of deceased. The applicant is in custody since 28.12.2021.

3A. It is stated that two witnesses out of sixteen witnesses have already been examined.

Learned AGA has opposed the bail application.

¶16

Considering the fact that the applicant is in detention for about 4 years and has no criminal antecedent, I am of the view that the applicant is entitled to be enlarged on bail on that ground alone. In view thereof, the application is allowed .

Let the applicant- Suneeta be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties of Rs.20,000/- (Twenty Thousand) each of the like amount with

(a) The applicants shall execute a bond to undertake to attend the hearings;

(b) The applicants shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

(c) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
