प्राथीर् के िवद्वान अिधवक्ता श्री पीयूष कुमार िसह तथा िवद्वान अपर शासकीय अिधवक्ता श्री अशोक कुमार श्रीवास्तव को सुना तथा पत्रावली का अवलोकन िकया।

धारा 439 दं०प्र०सं०/483 भारतीय नागिरक सुरक्षा संिहता (B.N.S.S.) में प्रस्तुत इस प्राथर्ना-पत्र द्वारा प्राथीर् ने मुकदमा अपराध संख्या 217 सन 2025, अन्तगर्त धारा 115(2), 352, 351(3), 109 बी०एन०एस, थाना पयागपुर, िजला-बहराइच, में जमानत की प्राथर्ना की है।

िदनांक 3/7/2025 को प्राथीर्, उसके भाई, िपता तथा एक अज्ञात व्यिक्त के िवरुद्ध िलखाई गई प्रथम सूचना िरपोटर् में कहा गया है िक अिभयुक्तगण ने िशकायतकतार् से गांजा िपलाने को कहा तथा मना करने पर, उन लोगों ने िशकायतकतार् को लाठी-डंडा, मुक्का एवं थप्पड़ों से मारा -पीटा। िशकायतकतार् को घटना में पांच चोटें आई, जो सभी साधारण प्रकृित की थीं तथािप िचिकत्सक ने अपने बयान में कहा िक िसर की चोट से रक्तस्राव के कारण मृत्यु होना सम्भािवत था।

प्राथर्ना पत्र के साथ प्रस्तुत शपथ पत्र में कहा गया है िक प्राथीर् िनदोर्ष है। शपथ पत्र में एक अन्य प्रकरण में प्राथीर् की संिलप्तता दशार्यी गई है, िजसमें उसे जमानत िमल चुकी है।

प्रस्तुत प्रकरण में सह-अिभयुक्त उमेश कुमार @ होटल को इस न्यायालय द्वारा जमानत प्राथर्ना पत्र संख्या 7370 सन् 2025 में पािरत आदेश िदनांक 08.08.2025 द्वारा जमानत दी जा चुकी है।

उपरोक्त तथ्यों को दृिष्टगत रखते हुए, जबिक प्रथम सूचना िरपोटर् चार व्यिक्तयों के िवरुद्ध िलखाई गई है, िकतु दो अन्य व्यिक्तयों के िवरुद्ध लगाए गए आरोपों की िववेचना में पुिष्ट नहीं हुई है; घटना में कािरत सभी चोटें साधारण प्रकृित की हैं; प्राथीर् िदनांक 4/7/2025 से अिभरक्षा में है जबिक िववेचना पूणर् हो चुकी है तथा सह-अिभयुक्त को जमानत िमल चुकी है, न्यायालय का मत है िक प्राथीर् भी जमानत पर िरहा िकए जाने का अिधकारी है।

तदनुसार, जमानत प्राथर्ना-पत्र स्वीकार िकया जाता है।
