Heard learned counsel for the applicant, learned AGA for the State and perused the record. Whereas, no one has put in appearance on behalf of the informant despite notice.

The applicant seeks enlargement on bail in FIR No.408 of 2023, under Sections 302 IPC, P.S.- Kotwali Dehat, District- Balrampur.

It has been alleged that brother of the informant had a fight with the applicant, however, both of them went after the said petty fight and subsequently at the night, brother of the informant went missing and it was seen by the informant that the applicant was with the victim and after hitting him, he threw the victim in a well which resulted in his death. In the light of the said allegation, this Court passed an order dated 13.09.2024 directing that the statement of the witnesses at serial no.4-5 be recorded within two months. The said statements have been recorded and are on record annexed with the supplementary affidavit, wherein, it has been deposed that it appears that someone has hit the deceased with bricks, and thereafter, thrown him in the well.

Learned AGA has opposed the bail application.

Considering the fact that the material on record annexed with the supplementary affidavit, the cause of death which is the petty fight and the applicant has suffered pre-trial detention of almost four and a half

years coupled with the fact that he is in jail since 21.07.2023 having no criminal antecedents, he is entitled to be enlarged on bail. In view thereof, the application is allowed.

Let the applicant Ranu Verma be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/each with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which she is accused or suspected of the commission; and

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
