1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

2 . The applicant seeks enlargement on bail in S.T. No.916 of 2022 arising out of Case Crime No.121 of 2022, under Sections 498A, 304B, 302, 201 IPC and Section 3/4 of D.P. Act, Police Station Khodahre, District Gonda.

3 . In terms of the FIR, it was alleged that that the daughter of the informant was married to the applicant on around two years ago and sufficient dowry was given, however, the entire matrimonial family used to harass her and subsequently, killed her and thrown the body in a tank with an intend to conceal it. Subsequently, the body was recovered and the FIR in question was lodged.

4 . The Counsel fro the applicant argues that the applicant himself had lodged a missing person report. He further argues that subsequently, PW1 has not supported the prosecution case and the P.W.-1 and P.W.-3 have been declared hostile.

5. Learned A.G.A. vehemently opposed the bail prayer.

6. Considering the statements annexed along with the rejoinder affidavit; the fact that major witnesses have not supported the prosecution case; no eyewitness of the incident; the applicant has no criminal history and is in

custody since 04.08.2022, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed .

7. Let the applicant Mukeem Ahmad be released on bail in the abovesaid first information report number on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶22

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
