Ankush Sharma vs State of U.P.

The instant application has been filed seeking release of the applicant on bail in Case Crime No.0013 of 2025, under Sections 7/12 of Prevention of Corruption Act, Police Station A.C.O., District Moradabad, during pendency of the trial in the court below.

Learned counsel for the applicant submits that applicant was contractual employee in Electricity Department and however there is no allegation that he made any demand of bribe from complainant but as per prosecution he received bribe money. He next submits that from the record it reflects that applicant received bribe money on the instructions of co-accused Rajeev Saini the clerk and therefore, co-accused Rajeev Saini appears to be prime accused. He further submits that if on the instructions of regular employee who is senior to applicant, applicant accepted the alleged bribe being contractual employee then it cannot be said that he also committed alleged offences under the provision of Prevention of Corruption Act. He further submits that applicant is not having any criminal history and investigation of the case has been completed. He is in jail in the matter since 21.08.2025 i.e. for the last three months.

Per contra, learned AGA, however, opposed the prayer for bail but could not dispute the argument on facts advanced by learned counsel for the applicant.

I have heard both the parties and perused the record of the case.

However, as per allegation applicant received the bribe money from the complainant but it reflects there is no allegation of demand of bribe against him and it reflects he received the alleged bribe money on the instructions of co-accused Rajeev

Saini who was clerk and further applicant is not public servant and he is contractual employee.

Further, investigation of the case has already been completed and applicant is not having any criminal history and he is in jail in the present matter since 21.08.2025 i.e. for the last three months and law is settled, unless proven guilty an accused is deemed to be innocent and bail application should not be dismissed either for preventive or punitive purpose.

Therefore, considering the facts and circumstances of the case discussed above, in my view applicant is entitled to be released on bail.

Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed .

Let the applicant- Ankush Sharma be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:-

(i) The applicant shall appear before the trial court on the dates fixed, unless his personal presence is exempted.

(ii) The applicant shall not directly or indirectly, make inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer or tamper with the evidence.

(iii) The applicant shall not indulge in any criminal and anti-social activity.

In case of breach of any of the above condition, the prosecution will be at liberty to move an application before this Court for cancellation of the bail of the applicant.

It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
