HON'BLE SANTOSH RAI, J.
- Learned A.G.A. informs that counter affidavit is under preparation. He seeks two days' time to file counter affidavit.
- From perusal of the ordersheet, it appears that on 06.11.2025 and 27.11.2025 learned A.G.A. was directed to file counter affidavit. Despite time being granted learned A.G.A. has not filed counter affidavit. It shows negligence of prosecution agency. Disposal of bail application is adversely affected due to negligence, conduct and behaviour of learned A.G.A. and concerned prosecution agency but in the interest of justice two days' time is given to learned A.G.A. to file counter affidavit, as a last opportunity.
- If the counter affidavit is not filed within stipulated period, strict action shall be taken against the concerned person.
