1. Supplementary affidavit filed today in Court is taken on record.

2. Heard learned counsel for the applicant, learned AGA and perused the record.

3. The applicant seeks enlargement on bail in FIR No.184 of 2023, under Section 302/201 IPC, P.S. Pachdewara, District Hardoi.

4. The FIR in question was lodged on the basis of suspicion that the daughter of the informant was killed by the accused including the applicant. As there were no eyewitnesses, based upon the supporting evidence, the applicant was named in the offence in question and arrested. A supplementary affidavit has been filed wherein it is stated that one witness has declared hostile.

5. Learned AGA has opposed the bail application.

6. Considering the fact that the witness based upon whose statement the applicant was linked has turned hostile, the applicant who is in custody since 06.07.2023 and has no criminal antecedent is entitled to be enlarged on bail. In view thereof, the application is allowed.

7. Let the applicant Anangpal Singh @ Annu be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of

(a) The applicant shall execute a bond to undertake to attend the hearings;
