Heard learned counsel for the applicant, learned AGA, Ms. Afrin Bano who appears for the informant and perused the record.

The accused-applicant seeks bail in FIR/Case Crime No.857 of 2024 under sections 103(1), 137(2), 61(2), 3(5), 140, 238 BNS, P.S. Kotwali Nagar, District Sultanpur.

The FIR in question was lodged alleging that the son of the informant aged about eleven years went missing. Subsequently, the body of the child was recovered from the house of the accused including the applicant. The cause of death as per the postmortem report was ligature mark on the neck, abrasion on left dorsal palm, abrasion on upper mid thoracic back and abrasion on left clavicle area.

The contention of the counsel for the applicant is that the applicant is a lady and was implicated with the offence in question without there being any corroboratory evidence except the body was recovered from the house of the applicant. In the statement of the co-accused, which is a confessional statement on record, he took the name of the applicant also.

Considering the material on record, there is no direct material to link the applicant with the actual offence, the applicant is a lady aged about 40 years and is in custody since 27.11.2024 having no criminal history, thus, on that ground alone, the applicant is entitled for the bail. In view thereof, the bail

application is allowed.

Let the applicant Rizwana be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶21

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶22

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
