This bail application under Section 483 of B.N.S.S., 2023 has been filed by the applicant- Satish , seeking enlargement on bail during trial in connection with Case Crime No. 192 of 2025, under Section 80(2), 85 B.N.S. & Section 3/4 Dowry Prohibition Act, Police Station Soron, District Kasganj.

The first information report of the present matter was lodged on 12.04.2025 by Yadram against the applicant and 02 other persons alleging therein that his daughter Shivani was married to the applicant around 01 year back. The accused persons used to torture and assault her for additional dowry and due to non-fulfillment of the same on 11.04.2025 they murdered her. When he received information about it on phone from her father-in-law Balister he went to the hospital and found his daughter to be dead. A report be lodged and action be taken.

Learned counsel for the applicant submits that although the applicant is the husband of the deceased but he has been falsely implicated in the present case. It is submitted that the deceased committed suicide and died which is suggestive from the postmortem examination report, wherein, the doctor found a single ligature mark on her body and the cause of death has been opined as asphyxia as a result of antemortem hanging. It is submitted that the first information report is vague in as much as the factum as to what was the actual demand of dowry is not mentioned but later the same was improved by the first informant in his statement during investigation by adding that the demand was of a motorcycle. dowry has seen the light of the day for the first time when the present first information report has been lodged. While placing paragraph 25 of the affidavit it is submitted that the investigation in the matter has concluded and chargesheet has been submitted against the applicant and other co-accused persons. It is submitted that co-accused Balister and Smt. Guddo Devi being the father-in-law and mother-in-law of the deceased have been granted bail by a co-ordinate Bench of this Court vide orders dated 07.07.2025 passed in Criminal Misc. Bail Application Nos. 22327 of 2025 and 22357 of 2025, the copy of the said orders have been produced before the Court which are taken on record. The applicant has no criminal history as stated in para 28 and is in jail since 12.04.2025.

Per contra, learned counsel for the State vehemently opposed the prayer for bail and submitted that the applicant is the husband of the deceased. There is an allegation of demand of dowry, torture and harassment by the applicant and other co-accused persons. The deceased died within seven years of marriage in her matrimonial house. The death is unnatural.

After having heard learned counsel for the parties and perusing the record, it is evident that the applicant is the husband of the deceased. The deceased died within seven years of marriage in her matrimonial house. The death is unnatural. There is an allegation of demand of dowry, torture and harassment by the applicant and other co-accused persons. In so far as bail granted to coaccused Balister the father-in-law and Smt. Guddo Devi the mother-in-law of the deceased are concerned, their case is distinguishable with that the applicant since he is the husband of the deceased.

Looking to the facts and circumstances of the case, this Court does not find it a fit case for bail, hence, the bail application is rejected.
