This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant-Akash Kumar, seeking enlargement on bail during trial in connection with Case Crime No.104 of 2023, u/s 363, 366, 376(2)N, 376(3), 504, 506 IPC and Section 5L/6 POCSO Act, P.S. Chopan, District Sonbhadra.

This is a 3rd bail application. The first bail application of the applicant was dismissed for want of prosecution vide order dated 23.11.2023 passed by this Court in Criminal Misc. Bail Application No.50253 of 2023. Thereafter the second bail application of the applicant was rejected vide order dated 17.10.2024 passed by this Court in Criminal Misc. Bail Application No.4850 of 2024.

Learned counsel for the applicant states that the present bail application has become infructuous as the trial has concluded and the same be dismissed as having become infructuous.

As prayed by learned counsel for the applicant, the present bail application is dismissed as infructuous .
