His first bail application had been rejected vide order dated 05.03.2024 in Criminal Misc. Bail Application No. 50051 of 2023. Counsel for the applicant urged bail on the ground that only one witness had been examined, the trial was unlikely to conclude in the near future, and the applicant had been languishing in jail since 22.06.2023; the State (Mr. P.K. This is the second bail application of the applicant in Case Crime No. 231 of 2023, under Sections 420, 467, 468, 471 IPC, Police Station Izzat Nagar, District Bareilly.

Learned counsel for the applicant submits that the first bail application was rejected by this Court vide order dated 05.03.2024 passed in Criminal Misc. Bail Application No. 50051 of 2023, and as of now only one witness is examined and there is no chance of conclusion of trial in near future. The applicant is languishing in jail since 22.06.2023.

Mr. P.K. Singh, learned Brief Holder appearing for the State submits that the applicant has criminal history of three cases and other witnesses of fact are yet to be examined, who can be influenced by the applicant in case he is released on bail, therefore, for the offence which is serious in nature i.e. impersonating himself to be Javed Khan selling property by executing forged sale deed, thus, played fraud, therefore, the applicant is not entitled for the bail.

Having considered the submissions advanced by learned counsel for the parties and perusal of record, this Court does not find any good ground for grant of bail to the applicant in the present case.

The bail application is rejected. However, the trial court is directed to take all endeavours to conclude the trial expeditiously, preferably within a period of nine months from the date of production of a certified copy of this order.
