The FIR in question was lodged alleging that the informant along with her sister and father were coming home when the accused attacked and the father was hit with firearm and subsequently, the applicant and the other accused hit with a Ballam and Kanta, which subsequently resulted in his death. The cause of death as per the postmortem report is antemortem injuries sustained by the deceased and died on account of septicaemia arising out of the injuries.

The counsel for the applicant argues that the applicant was implicated only on account of the old enmity and is in custody since 18.11.2023 and has no criminal history.

The counsel for the informant opposes the bail application by arguing that the cause of death was attributed to use of weapon at the instance of the applicant. He further argues that all the fact witnesses have already been examined and even the doctor has also been examined. He however, does not dispute that the applicant has no criminal antecedents and the fact witnesses have already been examined.

In view thereof, there is nothing on record to demonstrate that the applicant if enlarged on bail can have any adverse affect on the trial, the applicant is entitled for the bail. Thus the bail application is allowed.

Let the applicant Shivanshu Singh be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶21

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶22

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
