Heard learned counsel for the applicant, learned AGA and perused the record.

The accused-applicant seeks bail in FIR/Case Crime No.515 of 2024 under sections 103(1), 61(2) BNS, P.S. Bilgram District Hardoi.

In terms of the FIR, it was alleged that the brother of the informant had a fight after drinking with the three accused including the applicant. Subsequently, he came home and on the next date he was found dead and an apprehension was expressed that the accused including the applicant may have committed the offence.The cause of death as per the postmortem report is ante-mortem head injury, however no recovery could be effected from the applicant and the applicant has no criminal history and is in custody since 25.10.2024.

Considering the evidence to link the applicant with the offence in question based upon the suspicion and no recovery from the applicant, the applicant who has no criminal history is entitled for the bail. Thus the bail application is allowed.

Let the applicant Vikram @ Vikram Singh be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
