1. Heard learned counsel for the applicant, learned AGA for the State; Shri Abhishek Mishra, learned counsel for the informant and perused the record.

2. The applicant seeks enlargement on bail in FIR No.94 of 2025, under Section 191(2), 191(3), 109(1), 190, 115(2), 351(3) BNS, P.S. Udaipur, District Pratapgarh.

3. In terms of the FIR allegations were levelled that on account of an enmity, all the accused attacked the brother of the informant and caused severe injuries with the use of Lathi, Danda etc. Injury report on record shows presence of as many as five injuries of which two are on the forehead and parietal region.

4. Submission of learned counsel for the applicant is that general role was assigned to all the accused and no recovery was affected from the applicant of any weapon. The applicant is in custody since 03.07.2025.

5. Learned AGA has opposed the bail application.

6. Considering the nature of the general allegation coupled with the fact that no recovery was affected from the applicant and the applicant has explained his criminal antecedents, the applicant is entitled to be enlarged on bail. In view thereof, the application is allowed .

7. Let the applicant Tarun Shukla be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/each to the satisfaction of court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
