The present application under Section 438 Cr.P.C. has been filed seeking anticipatory bail in FIR/ Case Crime No. 15 of 2023, under Sections 419,420,467,468,471,120B,204,386,506 IPC and Section 7(A) of P.C. Act, P.S.- S.I.T., District- Lucknow Gramin.
Learned AGA at the very outset has raised preliminary objection stating that the applicant has criminal history of same nature of 9 cases. As such, the applicant is not entitled for anticipatory bail.
In the prosecution case, it is alleged that the applicant is a member of gang and has committed forgery in District- Gonda. He along with the co-accused usurped the land of the complainant while hatching the conspiracy. He is alleged to have prepared the forged documents and also has participated with the aid of Government employees of the Registrar in replacing the original deeds with the forged one.
Perused the record.
On due consideration to the long criminal history of the applicant of same nature and the allegations made in the prosecution case, I am not inclined to entertain this anticipatory bail application.
In view of the above, no ground for grant of anticipatory bail is made out. Accordingly, the application for anticipatory bail is rejected.
