1.Heard learned counsel for the applicant and learned counsel appearing on behalf of private respondent as also learned A.G.A..

2.By means of present petition, the petitioner has prayed for quashing of entire proceedings of Crl. Case No.435 of 2022 Babita Maurya versus Sunil Kumar,

3.Learned counsel for the parties submit that the parties have settled the matter and signed settlement agreement before the Mediation & Conciliation Centre of this Court in compliance of this Court's order dated 19.9.2024 and 18.10.2024, passed in this petition and the first party has deposited a sum of Rs.1,10,000/- in this court via demand draft dated 27.9.2024. The second party has agreed for adjustment of said amount of Rs.1,10,000/- towards one time full and final settlement amount of Rs.1,20,000/-. The first party has also agreed that he will have no objection in case this court releases the said amount in favour of second party. The first party has also paid balance amount of Rs.10,000/- through RTGS which has been received by respondent No.2. Thus, it is prayed that in pursuance to the settlement agreement, the proceedings are liable to be quashed.

4.It is submitted on behalf of respondent No.2 that respondent No.2 may be permitted to withdraw Rs.1,10,000/- which has been deposited before this court.

5.I have perused the report of mediation dated 25.11.2024 which shows that the mediation has been successfully completed. The mediation report is on record. The settlement agreement has been signed by the parties and thus, considering the settlement agreement as well as the submission advanced by

the parties' counsel, the impugned proceedings are liable to be and are hereby quashed.

6.The petition is disposed of accordingly. The respondent No.2 is permitted to withdraw Rs.1,10,000/- deposited before this Court.
