Shri Abhinandan Kumar Pandey, learned counsel has filed Vakalatnama on behalf of opposite party no.2, which is taken on record.

This Court had passed an order on 18.08.2025 in following terms:

"1. Heard learned counsel for the applicants, the learned A.G.A. for the State and perused the record.

2. Instant application under Section 482 Cr.P.C./ 528 B.N.S.S. has been filed with the following prayer:-

"For the facts, reasons and circumstances stated in the accompanying Affidavit, it is most respectfully prayed that this Hon'ble court may kindly be pleased to quash the impugned charge sheet dated 18.1.2024 arising out of Case Crime No. 164/2023, under sections 498-A, 323, 504, 506 IPC and section 3/4 Dowry Prohibition Act, Police Station-Krishna Nagar, District Lucknow as well as cognizance/summoning order dated 11.6.2025 passed by the learned Additional Chief Judicial Magistrate, Court No.31, Lucknow in Criminal Case No.59097/2025 (State Versus Arpit Yadav & Others) including entire proceeding thereof, as contained in Annexure No.1 & 2 respectively to this petition.

It is further prayed that this Hon'ble Court may kindly be pleased to stay the further proceedings initiated in pursuance of the impugned charge sheet dated 18.1.2024 arising out of Case Crime No. 164/2023, under sections 498-A, 323, 504, 506 IPC and section 3/4 Dowry Prohibition Act, Police Station- Krishna Nagar, District Lucknow as well as cognizance/summoning order dated 11.6.2025 passed by the learned

Additional Chief Judicial Magistrate, Court No.31, Lucknow in Criminal Case No.59097/2025 (State Versus Arpit Yadav & Others) during pendency of the instant petition, in the interest of justice."

3. It is submitted by learned counsel for the applicants that the matter is arising out of the matrimonial dispute and there is still a possibility of settlement in between the parties, and therefore, the matter may be referred to the Mediation and Conciliation Centre of this Court.

4. Learned A.G.A. for the State has no objection if the parties are ready to settle their dispute.

5. In view of ascertaining the willingness of the opposite party no.2, the opposite party no.2 is directed to remain present before this Court on 27.08.2025 at 2:15 P.M.

6. The applicants are directed to fetch the bank draft/ demand draft of Rs.20,000/- on the said date.

7. Till then the criminal proceedings of Criminal Case No.59097 of 2025 (State Versus Arpit Yadav & Others), arising out of Case Crime No. 164 of 2023, under Sections 498-A, 323, 504, 506 IPC and Section 3/4 Dowry Prohibition Act, Police StationKrishna Nagar, District Lucknow, shall remained stayed. "

In compliance of this Court's order dated 18.08.2025, the opposite party no.2-Pooja Yadav, who has been identified by her counsel, is present before this Court. On specific query having been put to opposite party no.2, she has categorically stated that she is willing to sit in the Mediation Centre for mediation proceedings among her and the applicant no.1.

Learned counsel appearing for the applicants has submitted that a Demand Draft of Rs.20,000/-(Rupees Twenty Thousand) had already been prepared in favour of the Senior Registrar, Mediation Center, High Court Lucknow and the same shall be submitted in the Mediation Center within a week.

In view of the aforesaid consensus arrived at in between the applicant no.1 and the opposite party no.2, this matter be referred to the Mediation and Conciliation Centre of this Court. The Mediation and Conciliation Centre of this Court shall fix dates for carrying out the mediation proceedings amongst the parties.

Out of the aforesaid Rs.20,000/- (Rupees Twenty Thousand), Rs.15,000/-

(Rupees Fifteen Thousand) shall be paid to the opposite party no.2 towards expenses for appearing in the mediation proceedings.

The Mediation and Conciliation Centre of this Court is hereby directed to complete the mediation proceedings and place its report before this Court within a period of two months.

List this matter on 03.11.2025 showing the name of Shri Abhinandan Kumar Pandey as counsel for the opposite party no.2.

Till the next date of listing, further proceedings of Criminal Case No.59097 of 2025 (State Versus Arpit Yadav & Others), arising out of Case Crime No. 164 of 2023, under Sections 498-A, 323, 504, 506 IPC and Section 3/4 Dowry Prohibition Act, Police Station-Krishna Nagar, District Lucknow, shall remained stayed.
