The instant application has been filed on behalf of the applicants with the prayer to quash the chargesheet No. A108 of 2022, dated 24.08.2022 filed in Criminal Case No. 1586 of 2023; State Vs. Santosh Singh and others, arising out of Case Crime No. 128 of 2022, under Sections 498A, 323, 504 IPC and Section 3/4 of Dowry Prohibition Act, Police Station Bhiti, District Ambedkar Nagar and summoning order dated 25.04.2023 passed by learned Addl. Civil Judge (JD), Ambedkar Nagar, as well as entire proceedings in pursuance thereof.

Learned counsel for the applicants submits that the matter pertains to matrimonial dispute without there being any specific allegation against the applicants for demand of dowry. He also submits that there is still possibility of amicable settlement in between the parties and, therefore, the matter may be referred to the Mediation & Conciliation Centre of this Court.

Learned Counsel for the State has no objection, if the matter is

being referred to the Mediation & Conciliation Centre of this Court. In view of the aforesaid and for ensuring the willingness of opposite party no. 2 for referring the matter to Mediation & Conciliation Centre, list/put up this matter on 27th of August, 2025. On the said date, opposite party no. 2 shall remain present before this Court.

Learned counsel for the applicants shall fetch a demand draft of Rs.20,000/- on the next date. "

In compliance of this Court's order dated 12.08.2025, the opposite party no.2-Rinki Singh, who has been identified by her counsel, is present before this Court. On specific query having been put to opposite party no.2, she has categorically stated that she is willing to sit in the Mediation Centre for mediation proceedings among her and the applicant no.1.

Learned counsel appearing for the applicants has submitted that a Demand Draft of Rs.20,000/-(Rupees Twenty Thousand) had already been prepared in favour of the Senior Registrar, Mediation and Conciliation Centre, Lucknow Bench, Lucknow and the same shall be submitted in the Mediation Centre within a week.

In view of the aforesaid consensus arrived at in between the applicant no.1 and the opposite party no.2, this matter be referred to the Mediation and Conciliation Centre of this Court. The Mediation and Conciliation Centre of this Court shall fix dates for carrying out the mediation proceedings amongst the parties.

Out of Rs.20,000/- (Rupees Twenty Thousand), Rs.15,000/(Rupees Fifteen Thousand) shall be paid to the opposite party no.2 towards expenses for appearing in the mediation proceedings.

The Mediation and Conciliation Centre of this Court is hereby directed to complete the mediation proceedings and place its report before this Court within a period of two months.

List this matter on 03.11.2025 showing the name of Shri Santosh Kumar Srivastava as counsel for the opposite party no.2.
