Heard Sri Syed Saifullah, Advocate holding brief of Ms. Sufia Saba, learned counsel for the applicants and Sri Rizwan Ahmad, learned AGA for the State.

The instant application has been filed seeking a direction to the Additional Principal Judge, Family Court-Ist, Jaunpur in Execution Case No. 1659 of 2022 to execute the recovery warrants dated 03.06.2023 upon respondent no.2 in accordance with law and recover the maintenance amount of Rs. 3,25,000/from the opposite party no.2.

On 28.11.2024, this Court passed the following order;

"1. Heard Mr. Mohd Faiz, the learned counsel for applicants and the learned A.G.A. for State.

2. Perused the record.

3. Applicants-Shakuntala Chaurasiya And Another, who are charge sheeted accused, have approached this Court by means of present application under Section 482 Cr.P.C. with the following prayer:-

It is, therefore, most respectfully prayed that this Hon'ble Court may kindly be pleased to allow this application and direct the concerned court i.e. Additional Principal Judge, in Executions Case 1689/2022 is roscope Family Court 1st Jaunpur to direct the concerned Police Station to execute the recovery warrants dated 03.06.2023 upon respondent no.2 in accordance with law and recovered the maintenance amount of Rs.3,25,000 from the opposite party no.2 or search the moveable as well as immoveable property of opposite part no.2 as early as possible otherwise, the applicants shall suffer irreparable loss and hardship.

And/or may pass such any other and further order which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case.

Considering the nature of the controversy involved in present application, let a report be submitted by Court concerned before this Court as to why the order of court could not be executed against opposite party-2. The requisite report shall be submitted before this Court on or before 17.01.2025.

5. Put up again as fresh on 17.01.2025. "

In response to thereto, the following report has been received from the Additional Principal Judge, Family Court-Ist, Jaunpur dated 20.12.2024 :

"उपररोक्त वविषय कके सम्बन्ध मम ससम्ममान वनविकेदन हहै वक यह विमाद वदनमानांक -08.08.2022 करो ममानननीय प्रधमान न्यमायमाधनीश, पररविमार न्यमायमालय, जजौनपपुर कके यहमानां सनांससस्थित हहआ तस्थिमा यह विमाद ममानननीय प्रधमान न्यमायमाधनीश , पररविमार न्यमायमालय, जजौनपपुर कके आदकेश कके अन प ुमालन मम अन्तररत हरोकर वदनमानांक-24.08.2022 करो इस न्यमायमालय मम प्रमाप्त हहआ हहै।

इस प्रकरण मम न्यमायमालय दमारमा वदनमानांक-01.06.2023 करो वविपकनी पर तमामनीलमा पयमार्याप्त ममानतके हहए मपु० 3,25,000/-रू० ककी विससूलनी हकेतपु वविपकनी कके वविरुद्ध आर .डब्लसू. जमारनी वकयमा गयमा , जजस पर सम्बसन्धत स्थिमानके ककी आख्यमा मय नकल जनी.डनी. ररोजनममाचमा सनां0-031 वदनमानांवकत-25.02.2024 वि ररोजनमामचमा सनां0-034 वदनमानांवकत-28.02.2024 इस आशय ककी प्रमाप्त हहई वक वविपकनी ककी वगरफ्तमारनी हकेतपु वविपकनी कके घर पर बमार -बमार दवबश दनी गयनी, वकन्तपु वविपकनी दसतकेयमाब नहहीं हहआ। घर पर वविपकनी कके नमाम ककी करोई विसतपु नहहीं वमलनी जजसके कपुकर्या ककी जमा सकके।

वदनमानांक-28.03.2024 करो समायलमा ककी ओर सके प्रमास्थिर्यानमा पत्र 15 ख प्रसतपुत हहआ, जजस पर यह आदकेश हहआ वक स्थिमानके ककी आख्यमा सनांलग्न हहै। समायलमा वविपकनी ककी चल -अचल सम्पजत्ति कमा वविविरण प्रसतपुत करके तस्थिमा पसूविमार्यादकेशमानपुसमार वविपकनी कके वविरुद्ध आर .डब्लसू. वि एन.बनी.डब्लसू. जमारनी वकयके जमानके कमा आदकेश भनी पमाररत वकयमा गयमा। अवग्रिम वनयत वदनमानांक - 18.05.2024 वि वदनमानांक-13.08.2024 करो वविपकनी कके वविरुद्ध जमारनी प् र सकेस पर स्थिमानमा ककेरमाकत जजलमा जजौनपपुर ककी आख्यमा मय प्रममाण पत्र ग्रिमाम प्रधमान इस आशय ककी प्रकेवषत ककी गयनी वक वविपकनी घर पर न रहकर ररोजनी ररोटनी कके जसलजसलके मम बमाहर रह रहमा हहै। इस न्यमायमालय दमारमा वदनमानांक -06.11.2024 करो पपुननः समायलमा कके प्रमास्थिर्यानमा पत्र पर यह आदकेश पमाररत वकयमा गयमा वक समायलमा वविपकनी ककी चल -अचल सम्पजत्ति कमा वविविरण मय सबसूत दमाजखल करके तस्थिमा पत्रमाविलनी मम वदनमानांक-30.01.2025 ककी तमारनीख वनयत ककी गयनी हहै। यह भनी उलकेखननीय हहै वक समायलमा दमारमा अभनी तक वविपकनी ककी चल-अचल सम्पजत्ति कके बमाबत करोई वविविरण इस पत्रमाविलनी मम दमाजखल नहहीं वकयमा गयमा हहै।

आख्यमा ममानननीय न्यमायमालय कके समक समादर प्रसतपुत करनके कके अनपुररोध कके समास्थि महरोदय करो प्रकेवषत ककी जमा रहनी हहै।"

It is apparent that the trial court has taken all coercive steps against the opposite party no.2. Despite the same, the opposite party no.2 could not be apprehended for execution of the proceedings.

In view thereof, the instant application is disposed of with a direction to the Superintendent of Police, Jaunpur to take all steps to implement the order of non-bailable warrant issued against the opposite party no.2 and co-operate with the directions issued by the Additional Principal Judge, Family Court-Ist, Jaunpur.
