यािचकाकतार् की िवद्वान अिधवक्ता श्रीमती नूतन ठाकुर तथा उत्तर प्रदेश लोक सेवा न्यायािधकरण के िवद्वान अिधवक्ता श्री िशखर आनंद की तरफ से उपिस्थत अिधवक्ता श्री रजत राज नारायण को सुना व पत्रावली का अवलोकन िकया।

भारतीय संिवधान के अनुच्छेद 227 के अंतगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतार् ने उत्तर प्रदेश लोक सेवा न्यायािधकरण को वाद संख्या 2410 वषर् 2022 को दो माह के भीतर िनस्तारण करने हेतु िनदेर्श देने का अनुरोध िकया है। उपरोक्त वाद यािचकाकतार् ने लघु दण्ड आदेश के िवरुद्ध प्रस्तुत िकया है।

यह तथ्य सवर्िविदत है िक सभी न्यायालय एवं न्यायािधकरण कायर् के अत्यिधक बोझ से जूझ रहे हैं। उत्तर प्रदेश लोक सेवा न्यायािधकरण एक लंबे समय तक सदस्यों की िरिक्तयों के साथ काम करता रहा है तथा न्यायािधकरण पुराने वादों का अत्यिधक बोझ है। ऐसी पिरिस्थित में वषर् 2022 में लघु दण्ड के िवरुद्ध प्रस्तुत िकए गए वाद पर शीघ्र िनस्तारण हेतु िनदेर्श देने का इस स्तर पर कोई औिचत्य नहीं है।

तदनुसार, यािचका िनरस्त की जाती है।

यािचकाकतार् न्यायािधकरण के समक्ष समुिचत प्राथर्ना-पत्र देकर शीघ्र सुनवाई का अनुरोध कर सकते हैं तथा न्यायािधकरण वादों के िस्थित देखते हुए यािचकाकतार् के अनुरोध पर सहानुभूितपूवर्क िवचार करेगा।
