यािचकाकतीर् के िवद्वान अिधवक्ता श्री अवनीश िसह तथा िवद्वान अपर शासकीय अिधवक्ता श्री राहुल शुक्ला को सुना व पत्रावली का अवलोकन िकया।

इस िरट यािचका द्वारा यािचकाकतार् ने िवपक्षी संख्या 2- िजला अिधकारी अमेठी को जनिहत गारण्टी अिधिनयम, 2011 की धारा 6 के अंतगर्त यािचकाकतार् की िद्वतीय अपील का शीघ्र िनस्तारण हेतु िनदेर्श देने का अनुरोध िकया।

िवद्वान अपर शासकीय अिधवक्ता ने यह प्रारंिभक आपित्त रखी िक जनिहत गारण्टी अिधिनयम के अंतगर्त सेवा प्राप्त करने वाले व्यिक्त को अपील अथवा िद्वतीय अपील प्रस्तुत करने का अिधकार है, िकतु सेवा प्रदान िकए जाने से व्यिक्त को उक्त अिधिनयम में कोई अिधकार प्राप्त नहीं है।

उक्त आपित्त के रखे जाने पर यािचकाकतार् के िवद्वान अिधवक्ता ने कहा िक इस यािचका पर बल नहीं देना चाहते हैं तथा उन्होंने यािचकाकतार् द्वारा उिचत प्रावधान के अंतगर्त अनुतोष मांगे जाने की अनुमित चाही।

तदनुसार, अनुमित के साथ यह यािचका बल न िदए जाने के आधार पर िनरस्त की जाती है।
