यािचकाकतार् के िवद्वान अिधवक्ता श्री अश्वनी कुमार ित्रपाठी को सुना तथा पत्रावली का अवलोकन िकया।

भारतीय संिवधान के अनुच्छेद 227 के अंतगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतार् ने िसिवल जज (प्रवर खण्ड), अयोध्या को मूल वाद संख्या 237 सन 2020 के शीघ्र िनस्तारण का िनदेर्श िदये जाने का अनुरोध िकया है।

उपरोक्त वाद यािचकाकतार् ने संिवदा के िविनिदष्ट अनुपालन के अनुतोष हेतु िदनांक 06.10.2020 को प्रस्तुत िकया था। िदनांक 09.03.2021 को आदेश में प्रितवादी की उपिस्थत का कथन है। प्रितवादी ने पिरवाद-पत्र िदनांक 17.02.2025 को प्रस्तुत िकया।

प्रकरण अभी वाद िबन्दु िवरिचत िकये जाने के स्तर पर लंिबत है।

उपरोक्त तथ्यों के दृिष्टगत रखते हुए, जबिक वाद संिवदा के िविनदर्ष्ट अनुपालन हेतु संिस्थत िकया गया है तथा इसके िनस्तारण में िवलंब से वादी के िहतों पर प्रितकूल प्रभाव पड़ रहा है; प्रितवादी ने िवचारण न्यायालय के समक्ष उपिस्थत होने के बाद कई वषोर्ं तक प्रितवाद प्रस्तुत नहीं िकया है तथा िवचारण न्यायालय ने कायर्वाही को तत्परता से चलाने हेतु कोई आदेश पािरत नहीं िकया; आदेश पत्र के अवलोकन से स्पष्ट है िक अनेक ितिथयों को िबना कोई कारण दशार्ए वाद की सुनवाई स्थिगत की गयी, यह यािचका इस िनदेर्श के साथ िनस्तािरत की जाती है िक िसिवल जज (प्रवर खण्ड), अयोध्या मूल वाद संख्या 237 सन 2020 की कायर्वाही िबना िकसी पक्ष को अनावश्यक स्थगन िदये हुए, शीघ्रतापूवर्क, िविधनुसार करना सुिनिश्चत करेंगे।
