Heard Shri Ritesh Kumar Srivastava, learned counsel for the petitioner, Shri S.M. Singh Royekwar, learned Additional Advocate General assisted by Shri Vikram Soni, learned Additional Chief Standing Counsel for the State. Shri Anurag Tyagi, learned counsel has filed his Vakalatnama, on behalf of the private-respondent, which is taken on record.

Shri Royekwar, learned Additional Advocate General for the State has advanced his submissions and has taken the Court through the provisions of the Indian Stamp Act, 1899 (in short, 'the Act of 1899'), U.P. Stamps Rules, 1942 as well as U.P. E-Stamping Rules, 2013 and it has been submitted that there are various Sections which amplify the Scheme of the Act to indicate that if certain particulars required to be mentioned are incorrectly provided then its consequence amounts to an instrument being unstamped. He has further elaborated that the Act of 1899 also contains provisions taking note of contingencies regarding a misuse of stamps or being spoiled or mutilated and how there can be return of such stamps and by whom and how refund can be made.

Shri Royekwar has further urged that though the U.P. E-Stamping Rules, 2013 are primarily in consonance with the substantive Sections of the Act of 1899, however, as far as certain appendix appended with the U.P. E-Stamping Rules, 2013 is concerned, there are certain discrepancies and he further submitted that he requires sometimes to examine the same

with the Officers of the Department concerned, so that, appropriate suggestions can be placed before the Court, so that the Scheme can be made error proof as far as possible.

Shri Tyagi, learned counsel appearing for the private-respondent submits that Shri Anuj Kudesia, Advocate shall be appearing in the aforesaid matter and he requires sometimes to address the Court.

Shri Ritesh Kumar Srivastava, learned counsel for the petitioner submits that he execution proceedings are pending before the Commercial Court-2, Lucknow on 26.11.2025. Shri Tyagi has submitted that he shall seek an adjournment on the said date so that the matter can be listed before the Executing Court post 09.12.2025.

In view of the aforesaid, list on 09.12.2025 for further hearing .
