Petitioner Jagram Singh sought expedited disposal of Sessions Trial No. 500/2020 (State Vs. Govind and 2 others) under Sections 498-A and 304-B IPC and Sections 3/4 Dowry Prohibition Act (Case Crime No. 0498/2019, P.S. Jaithara, District Etah), pending before Additional District Judge, Court No. 1, Etah. Noting that a coordinate Bench, by order dated 21.09.2023 in Criminal Misc. Bail Application No. 59217 of 2022 (Govind Vs. State of U.P.), had extended bail and directed conclusion of the trial expeditiously, preferably within six months, the Court held that non-conclusion of the trial gave rise to cause of action for the present Article 227 petition. 1. Heard learned counsel for the parties.

Present petition has been preferred with the following prayers:-

"(a) to direct the Trial Court i.e. Court of Additional District Judge, Court No. 1, Etah to expedite the Sessions Trial No. 500/2020 (State Vs. Govind and 2 others), under Section 498-A, 304-B I.P.C. and 3/4 Dowry Prohibition Act, Police Station-Jaithara, District-Etah in Case Crime No. 0498/2019 (State Vs. Govind and others) pending in the Court of Additional District Judge, Court No. 1, Etah, within stipulated period as fixed by this Hon'ble Court."

At the very outset, learned counsel for the petitioner sought the attention of the Court over the order dated 21.09.2023 passed by coordinate Bench of this Court in Criminal Misc. Bail Application No. 59217 of 2022 (Govind Vs. State of U.P.), wherein while extending bail in favour of the applicant, the coordinate Bench of this Court directed to conclude the trial against the applicant, as expeditiously as possible, preferably within a period of six months and learned Registrar (Compliance) is directed to communicate the order to the concerned court below within ten days.

Considering the availability of the order dated 21.09.2023, once the trial has not been concluded, cause of action arises in favour of the petitioner for filing the instant petition for seeking expedite disposal of the trial which is pending before the learned Court of Additional District Judge, Court No. 1, Etah.

In view of aforementioned facts and circumstances, learned Registrar (Compliance) is hereby directed to receive report regarding compliance of order dated 21.09.2023 from learned concerned court.

Put up this matter as fresh on 24.02.2025.

Let a copy of this order be given to the learned Registrar (Compliance), within 24 hours.
