Heard learned counsel for the applicant, learned AGA for the State and perused the record.
In the prosecution case, it is alleged that, influenced by the statements of the accused, the complainant deposited Fixed Deposit Receipts (FDRs) amounting to approximately Rs. 90–95 lakhs in the said institution suggested by the accused in the names of his parents. A substantial amount was also deposited in that bank through various agents. Despite the expiry of the prescribed period and demands made by the complainant and others, the said amounts were not refunded. Consequently, it is alleged that the applicant misappropriated the funds.
Learned counsel for the applicant submits that the complainant himself was serving as the Manager in Kalpat Real Estate Limited Bank. He has not appeared before the investigating officer to have his statement recorded, and instead, his statement was recorded telephonically. It is further submitted that no copy of the FDRs or deposit receipts has been provided by the applicant. The allegations are stated to be false, and the applicant is said to have been falsely implicated. The applicant has also explained his criminal antecedents in the bail application.
It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail.
Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant.
Having considered that the applicant is in custody since 07.02.2023; the alleged offences are punishable with imprisonment of up to seven years; the applicant has explained his criminal antecedents; and the offences are triable by a Magistrate, I am of the view that this is a fit case for granting bail to the

applicant.
Accordingly, the bail application is allowed .
Let the applicant Bhanu Pratap Singh , involved in Case Crime No. 1287/2021, U/S-406, 420, 506 I.P.C., Police Station- Kotwali Sadar, District - Lakhimpur Kheri, be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:-
(i) the applicant shall not tamper with the prosecution evidence;
(ii) the applicant shall not pressurize the prosecution witnesses;
(iii) the applicant shall appear on each and every date fixed by the trial Court.
Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed.
It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial.
