Heard learned counsel for the applicant, learned A.G.A. for the State, Shri Kaushal Tiwari, learned counsel for the informant and perused the record.

The applicant seeks enlargement on bail in FIR No. 46 of 2025, under sections 191(2), 191(3), 190, 109, 126(2), 352, 193(3) and 351(3) BNS, P.S. Shivratanganj, District Amethi.

Learned counsel for the applicant argues that in terms of FIR it was alleged that ten unknown persons and 2 to 3 known persons had attacked the brother of the informant which resulted in substantial injuries. Injury report is on record. He further submits that coaccused persons Girija Shankar Shukla, Adarsh Shukla and Devesh Shukla have been granted bail by coordinate Bench of this Court vide orders dated 21.11.2025, 24.11.2025 and 24.11.2025. The applicant seeks parity with the bail order of the said co-accused persons.

Learned A.G.A. has opposed the bail application.

Considering the general allegations levelled against all the persons and the fact that the applicant is aged about 49 years, however, without commenting upon the merits of the case, the applicant who is in jail since 3.5.2025 and has no criminal history is entitled to be

enlarged on bail. In view thereof, the application is allowed.

Let the applicant Shiv Naresh Yadav alias Lalu Yadav be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/- each to the satisfaction of court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
